He asked that the files and minutes be checked to see what the <br />agreements were with this developer. Mr. Marier noted that the <br />developer was at a meeting where he agreed he had an obligation. Mr. <br />Bisel explained he was under the impression that there is $20,000 that <br />the developer is to contribute regardless of whether or not the ponds <br />are to be completed. Mr. Marier noted that at a meeting Mr. Nelson <br />was told that his obligation in this improvement would be $20,000. He <br />asked that the minutes be researched for this information. <br />Mr. Stahlberg has prepared an assessment role for Deer Pass Trail. <br />The one question that has been raised concerns the property on the <br />cul -de -sac. The assessment has been prepared based on the front <br />footage of each of the three lots as indicated in the feasibility <br />study. He has given each lot an equal share of the original credit. <br />The North Road assessment was updated using the ENR index. Location <br />of the services will be a concern of the residents. Metro Waste <br />installed the services without notifying the residents and they are <br />not in the proper location. There will have to be a document prepared <br />for sharing a connection. Mr. Marier asked what the difference in the <br />cost of the hook up will be for the residents. Mr. Stahlberg will <br />have this information for the assessment hearing. <br />Mr. Stahlberg explained that there are state highway easements over <br />the property at 6808 Lakeview Drive. There is the possibility that <br />the State may abandon this easement in the future. He has sent a <br />letter to the highway department notifying them that a City facility <br />is on this easement and asking that the City be notified prior to any <br />proceedings for abandonment. <br />The Ash Street sewer and water improvement is completely petitioned. <br />There are three lots not serviced by water connections. <br />The Council took a recess at 8:25 P.M. Mayor Benson assumed the Chair. <br />Mr. Stahlberg explained that he has been unsuccessfull in obtaining an <br />easement for the sewer line over the Paul Montain property. He asked <br />for a resolution to proceed with eminent domain. Mr. Montain has <br />indicated that development around his property has caused him <br />problems. Mr. Stahlberg has offered what is considered to be an <br />appropriate figure for the easement and Mr. Montain has indicated that <br />the figure should be ten times as large. Mr. Hawkins indicated that <br />it would be 90 days before the City could enter the property using the <br />eminent domain procedure. He suggested trying to negotiate further. <br />Mr. Bisel and Mr. Marier said they would meet with Mr. Montain. <br />PAGE 10 <br />
