110 <br />COUNCIL MEETING DECEMBER 14, 1987 <br />Mr. Hawkins questioned the last sentence of the text in the proposed <br />Ordinance No. 22 - 87. He noted that title to the park land is <br />acquired by the City when the City accepts and signs the plat. He <br />felt this created extra work. Mr. Bisel was concerned about the <br />situation where a combination of land and cash would be required. Mr. <br />Hawkins said provisions would be written in the developers contracts. <br />He also noted that even though many communities have similar <br />dedication ordinances the state statute states that park dedication <br />must be a reasonable amount. Developers do expect to pay park <br />dedication but he would not be surprised if there is a challenge at <br />some point and time. <br />Mr. Bisel moved to approve the first reading of Ordinance No. 22 - 87 <br />and change the last sentence to read, "the cash payment will be <br />required prior to recording the plat." Mr. Marier seconded the <br />motion. Mrs. Anderson read the proposed ordinance. <br />Mr. Reinert asked what would happen when a developer plats in phases. <br />Mr. Schumacher explained a preliminary plat would be required of the <br />entire area. The Council would then be aware of what is coming and <br />write the developers agreement outlining how the park dedication is to <br />be completed. <br />Voting on the motion, motion carried unanimously. <br />CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br />ORDINANCE NO. 22 - 87 <br />AN ORDINANCE AMENDING THE LINO LAKES CITY CODE BY CHANGING THE PARK <br />DEDICATION FEE. <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota <br />does ordain: <br />Property Dedication. Section 1001.14 of the Lino Lakes City Code is <br />amended to read as follows: <br />AMENDMENT: ELIMINATE: "This equivalent shall be $160.00 per <br />dwelling unit to be constructed within such proposed <br />development or ten (10%) per cent of the fair market <br />land value of the development, whichever is less." <br />PAGE 4 <br />
