242 <br />COUNCIL MEETING <br />MARCH 14, 1988 <br />Mrs. Elsenpeter asked who would assume responsibility for <br />the ditch once it is cleaned out and reconstructed? Who is <br />going to determine when the ditch needs cleaning again? She <br />noted that time and again we see this very thing and this <br />entire plat hinges on the drainage ditch. The City says <br />they are not responsible, the County and RCWD both say they <br />are not responsible. It is a buck passing situation. She <br />felt the builder should be liable. Mr. Stahlberg explained <br />that the plan was designed by RCWD to correct present and <br />future problems and RCWD is funding it. <br />Mrs. Elsenpeter again asked who will assume responsibility <br />for the ditch for ever and ever? Mr. Reinert noted that <br />state law says RCWD has jurisdiction. Mr. Schumacher <br />explained that RCWD has taxing authority so there will be <br />money for cleaning all the ditches under their jurisdiction. <br />Mr. Bisel felt it is fortunate to have maps showing where <br />the water is and where it is going. One developer cannot <br />come in anymore and develop and dump water onto the <br />adjoining property. He has to control his water in his own <br />property. <br />A gentleman said three current lots are directly affected by <br />this proposed plat. He said he has not seen any drawings <br />showing more detail. He said people drive over the park <br />land all winter long and now people from this new <br />subdivision will be driving into his yard. <br />Mr. Irwin asked if there will curb and gutters. Mr. <br />Stahlberg said yes. <br />Mr. Ward, 1549 LaMotte Drive told the Council that he <br />already has water coming down LaMotte Drive toward his <br />property. Mr. Reinert said that he will not get additional <br />water from the new subdivision. Mr. Stahlberg referred to <br />the plat drawing and noted that at the most only 100 feet of <br />the new street will drain toward LaMotte Drive. All the <br />rest will drain into the subdivision. Mr. Mastro said that <br />during times of heavy rain the storm water drain down <br />LaMotte Drive and accumulates on the lowest lots. Mr. <br />Stahlberg said this would not change, but there will not be <br />additional water from the subdivision. <br />Mr. Mastro asked if there is a time table for cleaning the <br />ditch. Mr. Stahlberg explained that the City will be doing <br />this and he is not aware of the timetable.
