COUNCIL MEETING APRIL 25, 1988 <br />PLANNING AND ZONING BOARD REPORT - PETE KLUEGEL <br />Consideration of Ordinance No. 03 - 88, Temporary Truck <br />Parking in Residential Areas, First Reading - Mr. Kluegel <br />explained that for some time the Planning and Zoning Board <br />and the City Council have discussed the issue of large truck <br />parking in residential districts. The P & Z Board has <br />prepared a proposed ordinance to deal with this problem. <br />This ordinance would require a permit and would allow <br />parking if the request meets seven conditions as outlined in <br />the ordinance. The proposed ordinance would mean that there <br />would be certain areas in Lino Lakes that truck parking <br />would be entirely prohibited. <br />Mr. Bisel explained the point was to allow the person who <br />uses that type of a vehicle in his vocation to park the <br />vehicle for short periods of time when the driver is home <br />for the weekend or on a layover. Mr. Kluegel explained that <br />there are currently about eight residences in Lino Lakes <br />that would fit this ordinance. Mayor Benson expressed <br />concern regarding item number one in that it does not have a <br />time limit. Mr. Kluegel explained that the P & Z Board did <br />discuss this but decided not to put a time limit on it. Mr. <br />Kluegel explained that one of his concerns is a landowner <br />that has more than one truck. Mr. Reinert noted that the <br />ordinance did not contain a penalty. Mr. Hawkins explained <br />that this ordinance is an amendment to Ordinance B and that <br />Ordinance B contains penalty provisions. <br />There was discussion regarding local contractors who keep <br />large trucks at their residences. Mayor Benson felt this <br />was not addressed in this ordinance. Mr. Reinert felt that <br />they were not the issue in this ordinance and if there were <br />complaints regarding local contractors they could be <br />addressed at that time. Mr. Schumacher explained that many <br />local contractors are "grandfathered in" and can continue to <br />operate but not intensify their operation. He noted that <br />this particular ordinance addresses eighteen wheelers only. <br />Mr. Hawkins explained that the "grandfathered" businesses <br />are non - conforming and that the "grandfathered" use <br />continues with the land even if the land is sold. The <br />non - conforming use must be discontinued for one year before <br />it is considered no longer "grandfathered ". Mayor Benson <br />asked if this ordinance is attacking what the Council really <br />wanted attacked? Mr. Bisel explained it would eliminate the <br />problem of tractor trailers being used for storage, signage <br />etc. <br />PAGE 9 <br />
