083 <br />COUNCIL MEETING JUNE 13, 1988 <br />ditches and his opinion regarding responsibility for <br />maintenance. Mayor Benson asked that a policy for <br />maintanence of ditches be started and at least a portion of <br />the draft be ready by the next Council meeting. <br />CONSIDERATION OF ORDINANCE NO. 08 - 88 PROVIDING FOR THE <br />DEFERMENT OF SPECIAL ASSESSMENT - FIRST READING <br />Mr. Schumacher noted that this has been discussed for <br />several years and since there will be several assessment - <br />hearings this year he asked Mr. Hawkins to provide a draft <br />for such an ordinance. This draft lists several <br />requirements for deferment. The Council discussed several <br />items in the draft. Mr. Reinert felt this is a hard concern <br />to deal with. Mr. Bisel suggested that it is at least an <br />attempt to accomodate those citizens with hardships or <br />special cases.' Mayor Benson noted that petitioned projects <br />cannot afford to carry the weight of those who qualify for <br />deferments. Mr. Schumacher explained that this ordinance <br />would apply to all assessment projects regardless of whether <br />or not they were petitioned. <br />Mayor Benson noted that he had some problem with some of the <br />figures especially the Assessor's market value and the <br />amount of the gross assets. <br />Mr. Reinert moved to wait until the City Attorney is present <br />so that he can explain the justification of these figures. <br />Mr. Bisel seconded the motion. Motion carried unanimously. <br />OLD BUSINESS <br />Gearman Planned Unit. Development Proposal, General <br />Conditions - Mr. Schumacher explained that he and Mr. Miller <br />have met with Mr. Gearman regarding this matter and the P & <br />Z Board has recommended that Rice Lake Estates be rezoned <br />from R -7 to PUD and he also referred to Mr. Miller's <br />memorandum of June 10, 1988. In addition a letter was <br />prepared for Mr. Gearman to circulate among the current <br />residents in Rice Lake Estates explaining Mr. Gearman's <br />proposal to the City. Mr. Reinert expressed concern about <br />this matter and felt that Mr. Gearman was being given a <br />economic advantage over other city developers. <br />Jon Tenneson, 126 Egret - Mr. Tenneson expressed concern <br />regarding the advertising sign that lists the selling price <br />of the lots as $16,800. He asked if this included <br />assessment. Mr. Gearman said assessments were extra. He <br />PAGE 16 <br />
