COUNCIL MEETING <br />motion. <br />APRIL 10, 1989 <br />049 <br />Mr. Alan Irwin, 6466 Totem Trail explained that he was <br />pleased with the direction the City is taking on a trail <br />system and felt that the system would be good for residents <br />of all ages. He noted that Lino Lakes already has a Park <br />Dedication Ordinance that requires 10% of the land or a cash <br />equivalent. He asked if this is an additional requirement, <br />will this exceed the fair share for park dedication? He <br />suggested that this may come close to a constitutional issue <br />and asked if this is legal and should the City list the <br />reasons or justifications of the additional requirement. Mr. <br />Hawkins explained that there is no question that the City has <br />the right to the 10% requirement. However, this is not a <br />magic number and there is recent case law indicating that <br />this City must only show that the requirement is a reasonable <br />portion of the subdivision. The fact that the requirement <br />may benefit someone outside of the subdivision or plat is not <br />an issue. <br />Mr. Irwin asked if it would be beneficial to lay down the <br />reasons for adoption of the ordinance. Mr. Hawkins said that <br />there is plenty of background to draw the reasoning from such <br />as Park Board minutes, the recent City survey and the City <br />Planners comments. Mayor Benson said that it was also a <br />matter of record that some City developers have said that a <br />trail system helps to make the lots mpre saleable. <br />Mr. Irwin said his second concern is in regard to the <br />easements or actual dedication noted on the plats that will <br />be recorded at Anoka County. Mr. Hawkins explained that the <br />trails will be shown on the final plat and will be .marked <br />"parks ". There will be no other documents required for the <br />trails and will be recorded in the same manner as other park <br />dedication requirements. <br />Voting on the motion, Mr. Reinert, Mr. Bisel, Mr. Bohjanen <br />and Mayor Benson all voted, yea. Motion carried unanimously. <br />This ordinance is printed in the March 27, 1989 Council <br />minutes. <br />CONSIDERATION OF THE FOREST LAKE YOUTH SERVICE BUREAU <br />CONTRACT <br />Mr. Schumacher explained a contract has been received for the <br />services provided to our community for services of the Youth <br />Service Bureau. This contract is basically the same as the <br />contract for 1988 and he recommended approval of it. He <br />noted that item lA indicates that the compensation should not <br />exceed $1,200.00. The 1989 Budget does contain $1,000 for <br />this service and the Council asked that a letter be sent with <br />the signed contract explaining the fee of $1,000.00. <br />
