COUNCIL MEETING <br />PLANNER'S REPORT - JOHN MILLER <br />MAY 22, 1989 <br />Set Public Hearing, Conditional Use Permit for Robert <br />Simonson, June 12, 1989, 7:45 P.M. - Mr. Bohjanen moved to <br />set this public hearing. Mr. Bisel seconded the motion. <br />Motion carried unanimously. <br />Set Public Hearing, Preliminary Plat Review, Rohavic Oaks, <br />2nd Addition for June 12, 1989, 8:00 P.M. - Mr. Bisel moved <br />to set this public hearing. Mr. Neal seconded the motion. <br />Motion carried unanimously. <br />Set Public Hearing, Preliminary Plat Review, Parkview <br />Subdivision, June 12, 1989, 8:15 P.M. - Mr. Reinert moved to <br />set this public hearing. Mr. Bisel seconded the motion. <br />Motion carried unanimously. <br />Site and Building Plan Review for Chomonix Golf Course - Mr. <br />Miller explained that this agenda item is the result of the <br />Building Official finding that a pole building had been <br />erected in the Rice Creek Chain of Lakes Regional Park <br />without a building permit and without site and building plan <br />approval. The Planning and Zoning Board has considered the <br />request for the after - the -fact site and building plan review <br />and have recommended that the request be approved subject to <br />several considerations as follows: 1) both ends and the <br />side of the building facing the parking lot be faced with <br />cedar siding, 2) building permit fees be increased in <br />accordance with state guidelines for after- the -fact permits, <br />3) the county grant easements for drainage from the West <br />Shadow Lake Drive area west into park property and from the <br />Robertson Construction land north into park property, 4) the <br />county grant easements for sewer and water utilities and <br />trails on the north end of Reshanau Lake, and 5) the county <br />agree to accept utilities for the groundskeeper's house and <br />city water as a backup utility for the golf course. Mr. <br />Miller noted that the general agreement with the county is <br />that the easements will be given. Mr. Stahlberg will <br />determine location of the easements. <br />Mr. Reinert asked what assurance does the City have that all <br />the items will be completed. Mr. Miller explained that the <br />building will be upgraded within 120 days and it is his <br />understanding that the County will benefit in all the other <br />stipulations as well as the City. Mr. Bisel asked how one <br />unit of government could blatantly destroy our ordinances and <br />construct a building without permits? He felt that if this <br />negotiated settlement is approved, this City is saying it is <br />OK to disregard our ordinances providing something is given <br />in return. He asked how we could negotiate with the County <br />when the City has made several residents conform to the <br />ordinances. • <br />1 <br />1 <br />1 <br />
