1 <br />1 <br />1 <br />COUNCIL MEETING MAY 22, 1989 <br />Mrs. Margaret Langfeld, Anoka County Commissioner, told the <br />Council that she was here tonight to apologize for the error <br />the County has made noting it was a case of assuming the <br />contractor did obtain the necessary permits. She explained <br />that this does not remove blame from the County but she is <br />certain that the building would not have been built as it is <br />had the permit been requested. It is the goal of the County <br />to make the building presentable and to let the City know <br />that a public apology is sincerely given. <br />Mr. Reinert asked if the permits would have been applied for <br />in the appropriate manner, would a permit been issued? Mr. <br />Schumacher explained that pole buildings are allowed in only <br />certain commercial and industrial areas. However, the Chain <br />of Lakes Regional Park does not have a zoning and the City <br />Attorney has noted that it would be difficult to defend the <br />permit denial in court. Mr. Bisel said he could not ask the <br />citizens of Lino Lakes to do any more than the County <br />regardless of the zoning. Mr. Reinert said the person who <br />erred is the big problem. <br />It was noted that an overhang on the building was requested <br />by the City Planner. Mrs. Langfeld said that the County has <br />hired an architect to redesign the face of the building and <br />it would be impossible to construct an overhang with the <br />present design. <br />Mr. Reinert moved to accept option No. 1 as recommended by <br />the Planning and Zoning Board subject to the five conditions <br />laid out by the City Planner in his memorandum dated May 2, <br />1989 and these recommendation be in place within 120 days. <br />Mr. Palumbo from Anoka County noted that some items such as <br />easement locations and approvals may take longer than 120 <br />days. Mr. Reinert accepted Mr. Palumbo's comments. Motion <br />carried with Mr. Bisel voting no. Mr. Bisel explained that <br />he felt governments cannot be better than the people they <br />serve. <br />Set Public Hearing, Conditional Use Permit, Klosner - Goertz, <br />June 12, 1989, 8:30 P.M. - Mr. Bisel moved to set the public <br />hearing. Mr. Bohjanen seconded the motion. Motion carried <br />unanimously. <br />Elmer Crohn, Subdivision and Variance — Mr. Miller explained <br />that Mr. Crohn is asking to split approximately one acre <br />from the 120 acre parcel he owns along Main Street and is <br />currently in the process of platting. This would allow him <br />to sell the residence on the property while he is waiting for <br />the extension of utilities to the property. The variance <br />would reduce the lot size for the residence from two and one <br />half (2 1/2) acres to one acre. If for some reason utilities <br />do not become available and Mr. Crohn proceeds to plat in two <br />and one half (2 1 /2) acre lots he will be required to bring <br />this particular up to the code requirements.
