COUNCIL MEETING <br />SEPTEMBER 11, 1989 <br />Mr. Bisel moved to close the public hearing at 8:05 P.M. Mr. <br />Neal seconded the motion. Motion carried unanimously. <br />PUBLIC HEARING - TAX INCREMENT FINANCE DISTRICT NO. 1 -4 <br />Acting Mayor Reinert opened the public hearing at 8:05 P.M. <br />Mr. Miller explained that this district involves the <br />manufactures mall planned for the northeast quadrant of Lake <br />Drive and I35W. He noted a setback in timing explaining that <br />originally the developers had planned to start construction <br />this fall. The current plans are to start construction as <br />soon as the weather permits in the spring. The concern <br />facing the City is extension of utilities to the site and <br />obtaining financial assurances from the landowner. The TIF <br />attorney has recommended that the City obtain an agreement <br />from the property owner guaranteeing payment of construction <br />costs for utilities in the event that the mall is not built. <br />The landowner has not been willing to provide this guarantee. <br />In addition, the City does not have enough information from <br />the developer for the City's fiscal consultant. Mr. Miller <br />recommended that the Council open the public hearing and then <br />close the hearing until such time that all the details are <br />available. He will be back before the Council to ask that <br />another public hearing be set. <br />Acting Mayor Reinert asked Mr. Miller if it would be possible <br />for the landowner and the developer to get together and <br />guarantee the cost of utility installation. Mr. Miller said <br />this was possible, but told the Council he felt the City <br />should be very cautious about extending utilities if they <br />were not willing to guarantee payment of the cost. Mr. <br />Schumacher recommended that any further action by the City <br />Engineer cease until the status of the project is determined. <br />Mr. Bisel moved to close the public hearing at 8:12 P.M. and <br />not take public comment until all information is present and <br />another public hearing is called. Mr. Bohjanen seconded the <br />motion. Motion carried unanimously. <br />It was the opinion of the Council that the City does not want <br />to continue with additional engineering work or expense at <br />this time. <br />PUBLIC HEARING - VACATION OF PORTION OF EASEMENT FOR DRAINAGE <br />DITCH, 140 MARVY STREET, RESOLUTION NO. 61 - 89 <br />Acting Mayor Reinert opened the public hearing at 8:14 P.M. <br />Mr. Stahlberg explained that the owner of this property has <br />requested that the ditch be re- aligned so that he can make <br />better use of the land. He explained that the current <br />easement would have to be vacated and another easement would <br />be given by the landowner. Mr. Stahlberg showed the <br />property and the suggested alignment on the overhead <br />
