COUNCIL MEETING SEPTEMBER 11, 1989 <br />Attorney review of abstract document. Mr. Neal seconded the <br />motion. Mr. Uhde and his engineer were in the audience to <br />represent this development. <br />Mr. Neal asked if the park issue was resolved. Mr. <br />Schumacher explained that research of City records indicate <br />that this area was included in the park dedication from Mr. <br />Janderic for the Lakes Additions. However, another issue was <br />raised concerning the twenty nine (29) lots formerly owned by <br />NSP and purchased by Mr. Uhde. <br />Mr. Schumacher explained the problems encountered by staff <br />with phase development. He asked that Phase II of this <br />development be well "locked in" to avoid this type of <br />confusion. Mr. Stahlberg said he did not think the problems <br />encountered in the South Reshanau Lake Estates platting would <br />not happen again. Mr. Uhde explained that in the future <br />phase developing will be much clearer. <br />Acting Mayor Reinert was concerned about a situation where a <br />developer would "sit" on the lots until high taxes force them <br />to be developed. He also expressed concern about heavy <br />equipment and large truck hauling building material breaking <br />up Black Duck Drive. He said it would be unfair to this <br />subdivision to create premature aging of this street and the <br />expect the abutting residents to pay for its repair. Mr. <br />Volk explained that it would be tough to measure the wear and <br />tear on the street created by this new development. He <br />suggested that the developer submit a letter of credit or <br />bond to cover wear and tear that can be documented. <br />After further discussion, Mr. Volk recommended that stations <br />and pictures of Black Duck Drive be taken before and after <br />the construction. This could help establish liability. Mr. <br />Uhde said this would be fine with him but reminded the <br />Council of the normal spring breakup. He said he would have <br />no problem using his existing letter of credit to cover this <br />concern. Mr. Volk said the letter of credit must contain <br />language regarding Black Duck Drive. <br />Mr. Bisel amended his motion to include a request that the <br />developer and City Staff determine the condition of Black <br />Duck Drive at this time and at the end of �,he construction <br />phase to determine wear and include this in the letter of <br />credit. Mr. Neal seconded the amendment. Voting on the <br />motion and the amendment, carried unanimously. <br />Discussion of Drainage Plan for Outlot F - Mr. Stahlberg gave <br />a brief background on this matter. This lot has been platted <br />and it was the intention of the Council to deed portion of <br />the Outlot to adjoining landowners. This would put the <br />Outlot back on tax rolls and eliminate a concern for the <br />City. Before deeding the property to adjoining landowners, <br />it was suggested that the area be graded to provide adequate <br />
