279 <br />COUNCIL MEETING SEPTEMBER 11, 1989 <br />drainage and easements placed on the Outlot to insure <br />drainage. Mr. Stahlberg explained a grading plan was <br />provided by Mr. Roger Nelson who wishes to use the excess <br />materials for fill in lots he owns on the east side of Black <br />Duck Drive. Mr. Stahlberg has reviewed the grading plan and <br />recommended that it be revised so that there would be less <br />excavation and disruption to the area. <br />Mr. Neal said that if this area were to be graded, the <br />residents would be very upset. They want it to be left as it <br />is in the natural state. Mr. Schumacher said the original <br />reason this was brought up was to insure that there would be <br />proper drainage and place easements on the land so that the <br />new landowners could not alter the drainage after it was <br />established. Acting Mayor Reinert said he was unaware that <br />there were drainage problems in this area. Mr. Volk said <br />there were no major problems at this time, but if the land <br />were deeded to the adjacent landowners, they would alter <br />their lots by hauling in fill and this would cause problems <br />for the neighbors down the line. Acting Mayor Reinert asked <br />why this had not been done ten years ago before all the homes <br />were built. <br />After further discussion, Mr. Neal moved to leave Outlot F <br />as it is and put a stipulation in the deeds that will not <br />allow future landowners to alter the terrain and only <br />construct structures that will not change drainage patterns. <br />Mr. Bisel seconded the motion. Mr. Hawkins asked if this <br />area will be needed in the future for drainage purposes. If <br />so, he suggested that the easements be placed on the property <br />before it is deeded to the landowners. Voting on the motion, <br />motion carried unanimously. <br />Mr. Bisel asked what would happen to the parcels that are not <br />deeded to the adjacent landowners. It was suggested that <br />some landowners may want to buy more than one lot. Mr. <br />Schumacher explained that he has had several meetings with <br />the landowners and has a fairly good idea who wants <br />additional land. Mr. Schumacher was asked to contact the <br />landowners and get a list of those who want property and <br />bring this information back to the Council. <br />CONSIDERATION OF " "HE CENTENNIAL JOINT POWERS AGREEMENT AS <br />AMENDED <br />Mr. Schumacher explained that this is the fourth draft of the <br />Joint Powers Agreement and gave a brief background on the <br />matter. He noted that this would be the first reading of the <br />draft and a second reading would be required. There has been <br />input from the City Attorney's from all three cities. Mr. <br />Bisel said he found it difficult to determine if anything has <br />been left out of this draft. Mr. Schumacher explained that <br />all issues raised by the three cities were addressed and all <br />the agreed upon changes have been incorporated in this draft. <br />
