3 19 <br />COUNCIL MEETING OCTOBER 23, 1989 <br />Fire District Joint Powers Agreement as presented by the <br />Steering Committee. Mr. Reinert seconded the motion. Motion <br />carried unanimously. <br />ENGINEER'S REPORT <br />Status Report on Lakeview Estates, Ron Stahlberg - Mr. <br />Stahlberg explained that Braun Engineering has evaluated the <br />situation in Lakeview Estates and all of their <br />recommendations for correcting the street, curb, gutter and <br />storm sewer problems have been implemented or will be <br />shortly. The final lift of blacktop is scheduled for later <br />this week or next week. Mr. Stahlberg also noted that the <br />City is still holding a letter of credit and contractor's <br />deposit and neither of these items will be released until Mr. <br />Roessler supplies evidence that all subcontractors have been <br />paid. In addition, the City will hold a certain amout of <br />escrow until all problems in this subdivision have been <br />settled. <br />Mr. Bisel asked what will happen in the spring to this <br />subdivision? Mr. Stahlberg said that a portion of Mr. <br />Roessler's escrow will be held in case other corrective <br />measures are needed. <br />Consideration of 24th Avenue (Elmcrest) Improvement, Dan <br />Boxrud - Mr. Boxrud explained that when this matter was <br />previously before Council, he and the Staff had been <br />instructed to hold a neighborhood meeting with the affected <br />property owners for Phase I of this improvement (Main Street <br />south to Ash Street). This meeting was held on October 10, <br />1989 and the basic message from the affected landowners to <br />the Council was, the summary of the project is appropriate <br />but they want to see involvement in the improvement by both <br />cities and both counties. Their reasoning is that the street <br />is used by many people who do not live on the street but <br />people trying to get from one point to another. Mr. Boxrud <br />felt that a 100% petitioned improvement was very unlikely. <br />He recommended that the Council proceed with an informal <br />public hearing with the residents so the Council can decide <br />whether to proceed with a formal feasibility study. <br />Mayor Benson asked if the residents understand that the <br />counties are not inte—_ 3ted in pa ticipating in the <br />improvement. Mr. Boxrud said yes, but felt they as <br />disgruntled citizens could have greater force with the county <br />authorities than the City Councils. They were told that <br />neither county has any policies that would encourage county <br />participation. <br />Mr. Bisel asked why 24th Avenue could not be a county road <br />such as County Road J since both are boundary streets. Mr. <br />Boxrud explained that although both Lino Lakes and Hugo look <br />at 24th Avenue as collector streets, the southern end of the <br />
