1 <br />COUNCIL MEETING OCTOBER 23, 1989 <br />him enough time to gather facts on the matter and since the <br />rezone request came as a suprise, he asked that the hearing <br />be postphoned until the next Council meeting. He also noted <br />that it would have been helpful if a definition of the zoning <br />classifications would have been included with the <br />notification along with the permitted uses. Mr. Miller <br />explained why the notices were late and noted that this would <br />not invalidate the proceedings tonight. However, the Council <br />could continue the public hearing until the next Council <br />meeting. Mr. Gontarek said he would like the hearing <br />continued. <br />Mr. Gontarek explained that he felt the R -1 zoning for the <br />Crystal Court cul -de -sac was not good enough because he felt <br />that all of the current structures exceed the R -1 minimum <br />standards. He noted that the current developer has built <br />quality homes and has promised to continue doing so as the <br />land to the north is developed. However, Mr. Gontarek noted <br />developers can and do change in midstream. Zoning the area <br />R -1X would guarantee that the homes would be of like quality. <br />Mr. Gontarek explained that his second concern regarded the <br />number of lots platted on Outlot B. He thought that the <br />entire area was zoned R -1X requiring larger lot sizes and now <br />magically three lots appear on Outlot B. He suggested that <br />the third lot be split and added to the two lots on either <br />side of this lot. He felt that the Council was sending mixed <br />messages to the residents in his area and said it appeared <br />that Outlot B was being rezoned because the lot sizes would <br />not conform to the R -1X requirements. <br />Mr. Reinert said he was very concerned about the timing of <br />the notifications to the residents. He noted that if the <br />current homes on the cul -de -sac are zoned R -1X he would be <br />concerned about Outlot B being rezoned to R -1. Anyone could <br />come in and build a straight R -1 home. <br />Mr. Bisel asked if the current homes on the cul -de -sac exceed <br />the R -1X zoning. It was explained only the houses, the lots <br />are zoned R -1 and meet the standards of the R -1 zone. <br />Bisel asked Mr. Gontarek if the new lot~ remainee the <br />same size as his lot, would he be satisfied if the builder <br />constructed R -1X homes? Mr. Gontarek said no because first <br />there were two lots platted for the Outlot and now there are <br />three lots platted. The developer has promised like quality <br />homes on these lots, but developers can change. There is no <br />guarantee that R -1X homes would be constructed. From his <br />prospective there would be a better chance of an equal or <br />high quality home being built on the lot if the lot were <br />zoned R -1X and sized R -1X. Mr. Bisel suggested that there <br />could be some compromise on this situation. <br />Mayor Benson told Mr. Gontarek that the R -1X zoning does not <br />23 <br />
