Mr. <br />Gontarek agreed but noted that the market forces larger homes <br />on R -IX lots. <br />Mayor Benson asked if the zoning remained the same on Outlot <br />B and part of each lot remained in two different zones, how <br />would somebody decide to build, R -1 or R -1X. Mr. Hawkins <br />explained that normally when a zoning bisects a lot the <br />largest portion in a zoning decides the use. However, the <br />Lino Lakes ordinances do not say this but Mr. Hawkins said <br />this would still be the case. <br />Mayor Benson asked Mr. Miller if this hearing is delayed <br />until the next Council meeting, would this interfer with <br />anything that is being constructed now. Mr. Miller explained <br />that there is one house under construction and it is north of <br />the Outlots. <br />Donald Dunn, 6885 Black Duck Drive said that Mr. Miller's <br />explanation for the extra lot is not true. This would not <br />make the cul -de -sac symmetrical. In addition he was told <br />when he purchased his lot that the entire area north of the <br />creek was zoned R -1X. Mayor Benson said that the R -1X zoning <br />classification did not exist when these lots were zoned. His <br />lot-as well' as all the lots south of Reshanau Park Estates <br />are zoned R -1. Mayor Benson agreed that all the homes in <br />this area should be kept at one level of value. Mr. Dunn <br />said that allowing the extra lot would give the builder the <br />opportunity to change his requirements. He asked the Council <br />to reject the entire rezone request and leave the cul -de -sac <br />as it currently is. <br />Mr. Reinert explained that the ratio of land values to <br />improvements dictates that the improvements will be fairly <br />high. He noted that even in the older portion of the current <br />development, the homes exceed the R -1 classification. He <br />noted that whether the zoning remains R -1 or goes to R -1X <br />there will be higher quality homes that exceed what is <br />required in the ordinances today. Mr. Dunn said he could <br />also build an $80,000.00 home. <br />Mr. Gontarek said he did not feel that ar- `fi80,005.00 home was <br />a terrible home, but he did get concerned when the developer <br />started with two lots and now there are three lots. He noted <br />that the City had indicated that this is a strong part of the <br />City and that is why the R -1X zoning to the north. Also the <br />City wanted to maximium the return to the City. He said he <br />is concerned about protecting the value of his home. <br />Mr. Bisel asked that the definition of the R -1 and R -1X <br />zoning be given to the residents in the cud -de -sac area along <br />with lot sizes and house deminisions so that the residents <br />can make comparisons. Mr. Bisel said he had a problem with <br />the five lot cul-de-sac. <br />
