1 <br />1 <br />1 <br />COUNCIL MEETING <br />NOVEMBER 2 7, 1989 <br />sub - station. Currently UPA is planning to remove power poles <br />and lines from the easement it purchased from Mr. Art Hawkins <br />in the mid 1960's and replace them with higher, newer pole <br />structures for the operation of the sub - station. <br />This causes a problem regarding right -of -way for Mr. Hawkins <br />which does not involve the City of Lino Lakes. A second <br />problem involves wildlife, particularly wildlife that use a <br />flyway to Lake Amelia. The present power line does cause <br />some death loss, however, taller poles will cause an even <br />greater death loss. This problem also does not affect the <br />City, however the questions of land use is now raised. Does <br />this City want to see higher poles with additional guy wires <br />in an area that is zoned for Rural Executive housing? <br />Presently Mr. Hawkins and his daughter and son -in -law are <br />petitioning the Environmental Quality Board to require an <br />Environment Assessment Work Sheet (EAW) to be prepared by the <br />Environmental Quality Board. It is probable that the Board <br />will designate the City of Lino Lakes as the Responsible <br />Government Unit. The UPA would complete the EAW and send it <br />to the City for review. The City could then require an <br />Environment Impact Statement. It has not been determined who <br />would bear the costs of this matter. <br />An alternate route has been identified to the sub - station. <br />This route was outlined on a map previously sent to the <br />Council. Since the alternate route would cross land zoned <br />commercial and industrial, there would be no negative effect <br />on land value and no environmental impact. He suggested that <br />the Council ask the UPA to consider the alternative route. <br />Mr. Gary Ostrum explained that the owner of this property has <br />been approached and has said that he is not interested in <br />this new route. UPA would have to evoke power of <br />condemnation to acquire the right -of -way and to show just <br />cause for this action. This is not reasonable when UPA <br />already has an easement to the sub - station. <br />Mayor Benson asked if the counties have identified a time <br />table to upgrading this portion of Ash Street. Mr. Davidson <br />said he was not aware of any time table. This could affect <br />the right -of -way along Ash Street and maybe cause the poles <br />to be moved yet another time. <br />Mr. Hawkins told the Council of his background and why he <br />moved to this area. He noted that the changes in the <br />surrounding area have already diminished the original purpose <br />of attracting water fowl. He said the alternate power line <br />route would be better for his land. <br />Mr. Hawkins said he understood that there is not anything the <br />City can do in this matter. He will proceed with the <br />Environmental Impact statement request. <br />PAGE 8 <br />
