COUNCIL MEETING <br />ATTORNEY'S REPORT - BILL HAWKINS <br />FEBRUARY 12, 1990 <br />Lino Lakes Community Committee, Inc. - Mr. Hawkins explained <br />that this Committee had brought a lawsuit against the City <br />and the Judge ruled that the lawsuit was frivolous and <br />ordered the attorney for this group to pay the City $500.00 <br />of the expenses incurred in this matter. The time period for <br />payment of this fee has passed and Mr. Hawkins asked the <br />Council if they wanted him to pursue collection of the <br />$500.00. After discussing the matter, the Council asked that <br />Mr. Hawkins investigate the matter to determine if it would <br />be in the best interest of the City to pursue the matter. <br />Council Member Neal moved to pursue this matter to try and <br />obtain the $500.00 awarded by the court. Council Member <br />Bohjanen seconded the motion. Council Member Bohjanen noted <br />that it may be to costly to try and collect anything beyond <br />the original award. Mr. Hawkins explained that since the <br />plaintiff was a non - profit organization, it may be very <br />difficult to go after the individuals involved. Mr. Hawkins <br />will check the status of the attorney representing this <br />corporation before pursuing the matter further. <br />On a roll call vote, motion carried unanimously. <br />SET PUBLIC HEARING FOR 1990 - 1991 COMMUNITY DEVELOPMENT <br />BLOCK GRANT FUNDS <br />Mr. Schumacher explained that originally he had planned to <br />hold the public hearing on February 26, 1990. However, <br />because of time constraints, he asked that the public hearing <br />be set for March 12, 1990 at 8:00 P.M. and February 26, 1990 <br />be set for a time of discussion by the Council. Mr. <br />Schumacher explained that the purpose of the public hearing <br />was to gather input from the citizens of Lino Lakes regarding <br />the Community Development Block Grant Funds. <br />Council Member Reinert moved to set the public hearing for <br />Monday, March 12, 1990 at 8:00 P.M. Council Member Bohjanen <br />seconded the motion. Motion carried unanimously. <br />PUBLIC HEARING - REZONE REQUEST, WENZEL PROPERTY <br />Mayor Bisel opened the public hearing at 7:30 P.M. Mr. <br />Schumacher explained that Mr. Miller is ill this evening and <br />read Mr. Miller's staff report dated February 5, 1990. Mr. <br />Miller proposed that the Council deny the rezone at this <br />time. He suggested waiting until a proposal for improvement <br />of the property was submitted before considering any rezoning <br />request. <br />After further discussion, Council Member Reinert moved that <br />since the City initiated the rezoning and no further <br />information regarding the proposal is available, to close the <br />1 <br />1 <br />1 <br />
