COUNCIL MEETING ATTORNEY'S REPORT - BILL HAWKINS FEBRUARY 12, 1990 Lino Lakes Community Committee, Inc. - Mr. Hawkins explained that this Committee had brought a lawsuit against the City and the Judge ruled that the lawsuit was frivolous and ordered the attorney for this group to pay the City $500.00 of the expenses incurred in this matter. The time period for payment of this fee has passed and Mr. Hawkins asked the Council if they wanted him to pursue collection of the $500.00. After discussing the matter, the Council asked that Mr. Hawkins investigate the matter to determine if it would be in the best interest of the City to pursue the matter. Council Member Neal moved to pursue this matter to try and obtain the $500.00 awarded by the court. Council Member Bohjanen seconded the motion. Council Member Bohjanen noted that it may be to costly to try and collect anything beyond the original award. Mr. Hawkins explained that since the plaintiff was a non - profit organization, it may be very difficult to go after the individuals involved. Mr. Hawkins will check the status of the attorney representing this corporation before pursuing the matter further. On a roll call vote, motion carried unanimously. SET PUBLIC HEARING FOR 1990 - 1991 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS Mr. Schumacher explained that originally he had planned to hold the public hearing on February 26, 1990. However, because of time constraints, he asked that the public hearing be set for March 12, 1990 at 8:00 P.M. and February 26, 1990 be set for a time of discussion by the Council. Mr. Schumacher explained that the purpose of the public hearing was to gather input from the citizens of Lino Lakes regarding the Community Development Block Grant Funds. Council Member Reinert moved to set the public hearing for Monday, March 12, 1990 at 8:00 P.M. Council Member Bohjanen seconded the motion. Motion carried unanimously. PUBLIC HEARING - REZONE REQUEST, WENZEL PROPERTY Mayor Bisel opened the public hearing at 7:30 P.M. Mr. Schumacher explained that Mr. Miller is ill this evening and read Mr. Miller's staff report dated February 5, 1990. Mr. Miller proposed that the Council deny the rezone at this time. He suggested waiting until a proposal for improvement of the property was submitted before considering any rezoning request. After further discussion, Council Member Reinert moved that since the City initiated the rezoning and no further information regarding the proposal is available, to close the 1 1 1
