1 <br />1 <br />1 <br />COUNCIL MINUTES AUGUST 27, 1990 <br />list of permitted uses in that district a two - family dwelling <br />was constructed. <br />For several years the two - family dwelling has been rental <br />property. The Schillings now wish to subdivide the lot and <br />sell each to the two families currently residing there. This <br />requires a "zero" lot line subdivision which requires a <br />Conditional Use Permit and Minor Subdivision approval. <br />There are separate wells and septic systems for each unit. <br />In addition a "Declaration of Covenants" has been prepared <br />and has been reviewed by the City Attorney. Mr. Hawkins has <br />reviewed this document and feels it is adequate. The Design <br />Review Board (DRB) has recommended approval of both the <br />Conditional Use Permit and the Minor Subdivision. <br />Mayor Bisel asked if there was anyone in the audience to <br />speak for or against the request. Mr. Jim Schilling owner of <br />the two - family dwelling explained that since he lives in <br />Forest Lake he cannot control the property adequately. There <br />have been some problems and he felt owners would care for the <br />property better than renters. <br />Council Member Bohjanen moved to close the public hearing at <br />7:20 P.M. Council Member Kuether seconded the motion. <br />Motion carried unanimously. <br />Council Member Kuether asked Mr. Schilling what happens when <br />one owner does not agree with what the other owner is doing. <br />Mr. Schilling explained that the "Declaration of Covenants" <br />is similar to a town home regulation so that both owners <br />would have to agree with any major repair, etc. <br />Voting on the motion, motion carried unanimously. <br />Council Member Bohjanen moved to approve the Minor <br />Subdivision as outlined in DRB application No. 90 - 32. <br />Council Member Kuether seconded the motion. On a roll call <br />vote, motion carried unanimously. <br />Council Member Bohjanen moved to approve the Conditional Use <br />Permit. Council Member Kuether seconded the motion. On a <br />roll call vote, motion carried unanimously. <br />PUBLIC HEARING, CONDITIONAL USE PERMIT, DEAN QUIMBY, OPERATE <br />AN AUTO REPAIR SHOP <br />Mr. Miller explained that Mr. Quimby is currently revi,r='ng <br />his site plan to meet requirements of the Rice Creek <br />Watershed District (RCWD) and this is taking longer t he <br />had anticipated. Mr. Quimby is requesting that the is <br />hearing be continued to September 7, 1990 at 7:15 P.Y. sir. <br />Miller explained that Mr. Quimby is following the Dev per's" <br />Reference Guide and his plan is very good. <br />PAGE 3 <br />
