1 <br />1 <br />1 <br />COUNCIL MEETING DECEMBER 20. 1990 <br />preliminary plat. He asked if it would be appropriate to set <br />this public hearing. Mr. Miller explained that the Rice Creek <br />Watershed District will meet prior to January 28, 1991 and should <br />take action on the proposed plat prior to the public hearing. <br />Council Member Neal moved to set the public hearing as outlined <br />above. Council Member Bohjanen seconded the motion. Motion <br />carried unanimously. <br />Minor Subdivision Request for Jack Menkveld for Lot 6, Block 3, <br />Ulmer's Rice Lake Addition - Mr. Miller explained that this is <br />another in a series of requests to split lots along the new <br />Second Avenue. The lot is one (1) acre and wass platted so that <br />it could be divided when sewer and water was available. This <br />action would be considered infilling. Since the time this lot <br />was platted, the City Code has been changed with respect to lot <br />size. A variance is also required to allow the lot split. <br />Council Member Bohjanen moved to approve the DRB application No. <br />90 -60 approving the minor subdivision request. Council Member <br />Neal seconded the motion. On a roll call vote, motion carried <br />unanimously. <br />Council Member Neal moved to approve the variance request in DRB <br />application No. 90 -67. Council Member Bohjanen seconded the <br />motion. On a roll call vote, motion carried unanimously. <br />POLICE DEPARTMENT POLICY CHANGES REGARDING THE CITY OF <br />Chief C- ampbell explained that his department has not been <br />formally told by the City of Centerville that the Lino Lakes <br />Police Department will no longer be servicing the City of <br />Centerville when the contract date has ended. He noted that his <br />department has Centerville police records for the past fifteen <br />(15) years and will maintain these files. There are some pending <br />court cases and the Lino Lakes officers involved in these cases <br />may have to attend court. Chief Campbell will notify the City of <br />Centerville of the time the officers spend in court and will ask <br />for reimbursement of the officers salaries for the court time. <br />There was discussion regarding the length of time the Lino Lakes <br />officers could be out of the City at court on Centerville matters - <br />and what would happen if the City of Centerville refused to <br />reimburse the City of Lino Lakes for the officers expenses. The <br />City Attorney did advise the Council that he was quite sure that <br />there was nothing in the contract requiring the City of <br />Centerville to reimburse Lino Lakes. The City Attorney did note <br />that there is nothing of a serious nature pending for the City of <br />Centerville He also noted that there is no legal basis-to sue <br />the City :.of Centerville.- <br />PAGE 3 <br />i64 <br />
