1 <br />1 <br />1 <br />COUNCIL MINUTES FEBRUARY 25, 1991 <br />ENGINEER'S REPORT <br />Consideration of a Variance for Darla Lowell Regarding Road Width <br />of the Proposed 66th Street, DRB Application No. 91 - 02 - The <br />improvement hearing for 66th Street was held by the Council and <br />this improvement is in the sixty (60) day waiting period. In the <br />mean time, Ms. Lowell has submitted a request for a variance, DRB <br />Application No. 91 - 02. In a separate letter, Ms. Lowell <br />requested that the Council consider changing the ordinance for <br />street improvement in rural areas. Mr. Boxrud gave a brief <br />background on this matter indicating that the criteria for street <br />standards had been changed in the spring of 1990. Concrete curb <br />and gutter is now required for all streets in Lino Lakes even <br />though the streets may be in rural areas. <br />The DRB considered the request for the variance and concluded the <br />only reason to consider a variance was for financial reasons. <br />This does not meet the test of the six findings of fact and the <br />DRB recommended denial of the variance application. The DRB also <br />recommended that the ordinance not be changed. They felt that a <br />urban street with concrete curb and gutter is much easier to <br />maintain than a rural street with ditches. They also considered <br />aesthetics when making their decision. <br />The City Attorney told the Council if they wanted to accommodate <br />the Lowell's it should not be with a variance but with an <br />ordinance change. However, he noted that much time and planning <br />was put into the current ordinance and it appeared to set the <br />pace for orderly improvement. <br />Council Member Reinert moved to approve the DRB and City <br />Attorney's recommendation and deny the variance request and <br />ordinance change request as outlined in Option No. 3 of Mr. <br />Boxrud's "green sheet" dated February 20, 1991. Council Member <br />Neal seconded the motion. On a roll call vote, motion carried <br />unanimously. <br />CONSIDERATION OF RESOLUTION NO. 14 - 91 URGING THE MINNESOTA <br />LEGISLATURE TO RETAIN THE MINNESOTA FISCAL DISPARITIES <br />CONTRIBUTION RATE AT ITS PRESENT FORM <br />Mr. Schumacher explained that the North Metro Mayors Association <br />is very upbeat about supporting this resolution. He also <br />provided an outline of how fiscal disparities is calculated. <br />Council Member Reinert moved to adopt Resolution No. 14 - 91 <br />urging the Minnesota Legislature to retain the Minnesota fiscal <br />disparities contribution rate at its present form. Council <br />Member Kuether seconded the motion. On a roll call vote, motion <br />carried unanimously. <br />PAGE 8 <br />272 <br />
