273 <br />COUNCIL MINUTES, <br />FEBRUARY 25, 1991 <br />Resolution No. 14 - 91 can be found at the end of these minutes. <br />CONSIDERATION OF PARK LAND DEDICATION IN THE LAKE CREST AREA <br />Mr. Schumacher explained that he has met with the Park Board and <br />three (3) issues were discussed: 1) Comprehensive Park Plan, 2) <br />development of new elementary school site in joint cooperation <br />with Centennial School District, and 3) acquisition of park land <br />adjacent to Lake Crest. The Park Board felt it was most <br />important to prepare a proposal for the Council to consider and <br />determine the staff responsibility and the consultant <br />responsibility in the preparation of the Comprehensive Park Plan. <br />The second priority of the Park Board was acquisition of the site <br />adjacent to Lake Crest. Mr. Schumacher recommended that the <br />Council not consider this acquisition until the Comprehensive <br />Park Plan is completed since it might be foolish to obtain the <br />land and then find that the Comprehensive Park Plan would not <br />accommodate the parcel. <br />The option on the land adjacent to Lake Crest expires March 5, <br />1991. The seller is proposing to put the property back on the <br />market if the City does not exercise its option. Earlier on Open <br />Mike, residents expressed their desire that a park be established <br />for their area. Mr. Schumacher explained that the City presently <br />owns about 14 lots on the east side of Black Duck Drive that <br />could be used for park purposes. <br />Discussion regarding extending the option with the seller was <br />discussed. Mr. Joyer, representing the owner of the property <br />said this was possible if there really is an interest by the City <br />to purchase the property and if the City would agree to terms or <br />a contingency. He did not think the seller would further the <br />situation as it now stands. Mr. Joyer explained that it is <br />properly zoned for single family housing and a small commercial <br />area. Although the water table is high in the area, there is <br />still the potential for development. However, Mr. Joyer said <br />that it is the sellers intent to be as cooperative as possible <br />with the City. However, he is looking toward a purchase <br />agreement with loop holes or options that would be needed by the <br />City. It was noted that if at the end of the park study, this <br />parcel looked like it was best suited for park purposes, the City <br />could institute condemnation proceedings. Mr. Hawkins explained <br />that this would be a costly process but it is an option to <br />negotiations. <br />Council Member Kuether said she would like to save the property <br />by executing a purchase agreement. Council Member Reinert said <br />he would prefer to have the option agreement extended.
