t 10 <br />COUNCIL WORK SESSION JANUARY 17, 1989 <br />There was discussion regarding funding the costs of these <br />three ditch improvements. It was suggested to approach RCWD, <br />Anoka County and the developers. It was noted that some of <br />the landowners have already said they would pay their fair <br />share. Mayor Benson suggested that Mr. Stahlberg prepare a <br />map showing ditches that have been cleaned and ditches that <br />still need to be cleaned. <br />There was discussion regarding obtaining easements for <br />ditches. Mr. Hawkins explained the process could take two <br />weeks to four months. He noted that some landowners are not <br />willing to give easements so that the City would have to <br />negotiate a price for the easements. <br />Mayor Benson said the City could do some arm bending on the <br />local RCWD member. Mr. Bisel asked that these three ditch <br />proposals be pursued with RCWD, Anoka County and the <br />developers. Mayor Benson suggested that in the future plat <br />approvals could include making the developer responsible for <br />ditches beyond his property line. <br />Mr. Stahlberg was asked to prepare a map showing what ditches <br />were cleaned and when and what ditches need to be cleaned and <br />when <br />WEST CENTRAL TRUNK RIGHT -OF -WAY AND PERMIT STATUS <br />Mr. Stahlberg pointed out property on 2nd Avenue belonging to <br />Mr. Steve Begenisich. He noted at the public hearing it was <br />proposed to allow this property two hookups. Now that the <br />utility trunk route will cross the entire length of the <br />property, several more hookups are possible. He asked Mr. <br />Hawkins if another public hearing will have to be held <br />because of this proposed change. Mr. Hawkins explained that <br />the landowner could petition to waive the public hearing. He <br />suggested Mr. Begenisich and any other landowner whose <br />assessment is proposed to be increased be contacted and <br />offered an opportunity to petition to waive a public hearing. <br />There was discussion regarding the proposal that will be <br />before the Charter Commission on Thursday. It was noted that <br />the Council could still allow landowners to petition out of <br />an improvement if the new proposal was adopted. <br />Mr. Hawkins explained he had to leave this meeting for <br />another commitment. He explained he had received a question <br />regarding his position regarding the negotiations of the <br />Centennial Fire District Joint Powers Agreement. He <br />explained that he and h-is firm would not be available for any <br />legal opinions or actions on this matter since he represents <br />both Lino Lakes and Centerville.
