185 <br />COUNCIL MEETING JANUARY 23, 1989 <br />space. Mr. Reinert asked if there was a relationship of <br />liability to lack of maintenance. Mr. Burke explained that <br />would have to be proven. However, people are using ingenuous <br />grounds for lawsuits. <br />There was discussion regarding if the trails would be <br />designated for a particular use. Mr. Schumacher said this <br />would be decided when the trail plan is completed. Concern <br />was expressed about misuse of the trails by snowmobilers and <br />ATV owners. Questions regarding linking trails, the Regional <br />Park trail system and signing trails were discussed. Mr. <br />Bisel suggested that this ordinance be returned to Park Board <br />for the answer to three questions; 1) will the trails be <br />designated; 2) how will the use be determined; 3) who will <br />maintain them and at what cost. Mr. Schumacher was asked to <br />contact the City insurance carrier to determine what exposure <br />would be added to the liability insurance. Mr. Bisel moved <br />to send the ordinance back to the Park Board for answers to <br />these concerns. Mr. Bohjanen seconded the motion. <br />Mr. Hulse, 258 Rohavic was concerned about residents already <br />living in an area where trails are proposed. He noted that <br />he has snowmobilers crossing his property and has not been <br />able to do anything about it. Mr. Bisel said he would relay <br />Mr. Hulse's concern to the Park Board. <br />Voting on the motion, motion carried unanimously. <br />Mr. Uhde explained that he has a trail system designed for <br />his subdivision and wanted the Park Board to take into <br />consideration the fact that the developer is dedicating the <br />trails and asked that the Park Board consider park land trade <br />offs when trails are planned. <br />OLD BUSINESS <br />Draft Policy on Public Relation Issue as it Affects Residents <br />- Mr. Bisel moved to table this item until February 13, 1989. <br />Mr.Bohjanen seconded the motion. Motion carried <br />unanimously. <br />Mr. Reinert noted that after the problems concerning <br />surveying and digging on private property, he returned to his <br />residence to find four flags on his lot. The flags belonged <br />to Midwest Gas and later they were there with a jack hammer. <br />Mr. Bisel suggested that a hangar with a line for a telephone <br />number and name be prepared so that when someone is <br />considering entering private property for surveying or <br />something similar, they first place the hangar on the <br />doorknob and the homeowner will know who is on their <br />property. <br />Mr. Bisel moved to extend the meeting until the business at <br />hand is completed. Mr. Reinert seconded the motion. Motion <br />carried unanimously. <br />PAGE 10 <br />
