COUNCIL MEETING JANUARY 23, 1989 <br />with no priority designation. A decision on this matter will <br />wait until after the Elm Street neighborhood meeting which <br />was set for 7:00 P.M, January 26, 1989. <br />Width of 2nd Avenue as it passes north along the Menkveld <br />Sunrise Meadows Subdivision - Mr. Stahlberg asked the Council <br />if they want the width of 2nd Avenue to be 32 feet wide like <br />a normal residential street or 44 feet wide as required for a <br />state aid street. The Council agreed it should remain 44 <br />feet wide as originally planned. <br />ATTORNEY'S REPORT - JOHN BURKE <br />Mr. Burke did not have a report. <br />CONSIDERATION OF GAMBLING LICENSE REQUEST FOR LADIES <br />AUXILIARY TO VFW #6583 <br />Mr. Bisel moved to approve this license request. Mr. Neal <br />seconded the motion. Motion carried unanimously. <br />SECOND READING OF ORDINANCE NO. 01 - 89 DEFINING TRANSIENT <br />MERCHANT, PEDDLER, CANVASSER AND SOLICITOR <br />Mr. Schumacher noted that Mr. Hawkins and Chief Campbell have <br />prepared this ordinance and both are not present at this <br />time. Mayor Benson asked that this matter be addressed when <br />Chief Campbell returns to the Council chamber. <br />PARK BOARD REPORT - RANDY SCHUMACHER <br />Ordinance No. 02 - 89, Requiring Developers to Dedicate <br />Trails - Mr. Schumacher explained that trails were very high <br />on the survey completed last fall by the Park Board. <br />Therefore the Park Board has prepared a draft ordinance that <br />would require developers to dedicate paths and trails within <br />their subdivision. Mr. Schumacher also noted that the Park <br />Board is in the process of developing a trail system <br />throughout Lino Lakes. This will require developers to <br />dedicate lands for trails and this will be in addition to the <br />park dedication requirements already -in existence. Mr. Volk <br />has set up specifications for the trails and this includes <br />hard surfacing. <br />Mr. Reinert expressed concern regarding three items: 1) <br />liability; 2) projected costs of maintaining the trail <br />system; 3) infrigment upon adjacent landowners. He noted <br />that he may not be happy with a trail running past his <br />property. Mr. Schumacher explained that the trails would be <br />shown of the plat therefore persons purchasing lots would <br />know if 'a trail runs near their property. He also noted that <br />the liability would be the same as for any City owned <br />property. Mr. Burke explained the difference would be that <br />there would be added risk and exposure because there is added <br />PAGE 9 <br />
