181 COUNCIL MEETING VOTING ON THE MOTION: Bisel Neal Bohjanen Reinert Abstained: none Motion carried unanimously. ATTORNEY'S REPORT Kuether NOVEMBER 12, 1991 Update, Oak Brook Peninsula - Mr. Hawkins explained that a settlement in this matter is very near. a draft of the settlement is being prepared and he asked that the City Council approve the following, agreements: 1) place two (2) children at play signs in the affected area; 2) prepare and implement a schedule of periodically inspecting the street and present this inspection report to the homeowners for any necessary repairs. Mr. Hawkins noted that the claims for damages against the City have been dismissed and the City will no longer have the benefit of the insurance company (Mr. Allen Hoff) as legal counsel. He noted that after November 15, 1991, if the matter is not settled, the City will incur the legal costs, not the insurance company. Mr. Hawkins asked for approval to enter into the settlement agreement as described above. Council Member Neal moved to authorize the City Attorney to enter into the agreement described above. OLD BUSINESS Consideration of Vacancy on Charter Commission - Mr. Schumacher explained that Mr. Lyle Bye presented a resignation letter dated September 9, 1991 to Judge Gibbs. Mr. Bye's letter did not state his resignation date, but probably expected the date of the letter to be used as such. Mr. Hawkins asked if the Council wanted to recommend a replacement to Judge Gibbs for Mr. Bye's position. After discussion, the Clerk was asked to contact Mr. Bye and ask him to determine his date of resignation. If Mr. Bye's PAGE 10 1
