181 <br />COUNCIL MEETING <br />VOTING ON THE MOTION: <br />Bisel <br />Neal <br />Bohjanen <br />Reinert <br />Abstained: none <br />Motion carried unanimously. <br />ATTORNEY'S REPORT <br />Kuether <br />NOVEMBER 12, 1991 <br />Update, Oak Brook Peninsula - Mr. Hawkins explained that a <br />settlement in this matter is very near. a draft of the <br />settlement is being prepared and he asked that the City Council <br />approve the following, agreements: 1) place two (2) children at <br />play signs in the affected area; 2) prepare and implement a <br />schedule of periodically inspecting the street and present this <br />inspection report to the homeowners for any necessary repairs. <br />Mr. Hawkins noted that the claims for damages against the City <br />have been dismissed and the City will no longer have the benefit <br />of the insurance company (Mr. Allen Hoff) as legal counsel. He <br />noted that after November 15, 1991, if the matter is not settled, <br />the City will incur the legal costs, not the insurance company. <br />Mr. Hawkins asked for approval to enter into the settlement <br />agreement as described above. <br />Council Member Neal moved to authorize the City Attorney to enter <br />into the agreement described above. Council Member Kuether <br />seconded the motion. <br />VOTING ON THE MOTION: <br />Bisel <br />Bohjanen © Kuether <br />Neal © Reinert <br />Abstained: none, <br />Motion carried unanimously. <br />OLD BUSINESS <br />Consideration of Vacancy on Charter Commission - Mr. Schumacher <br />explained that Mr. Lyle Bye presented a resignation letter dated <br />September 9, 1991 to Judge Gibbs. Mr. Bye's letter did not state <br />his resignation date, but probably expected the date of the <br />letter to be used as such. Mr. Hawkins asked if the Council <br />wanted to recommend a replacement to Judge Gibbs for Mr. Bye's <br />position. <br />After discussion, the Clerk was asked to contact Mr. Bye and ask <br />him to determine his date of resignation.
