He recommended passage of <br />Ordinance No. 14 - 91. <br />Mr. Volk noted that is it currently illegal to discharge sump <br />pump water into the Metro Waste system. He also noted that this <br />water is clean and can be discharged by draintile onto the <br />surrounding lawns. It is illegal to discharge the water onto a <br />neighbors property. <br />After further discussion, Council Member Reinert moved to approve <br />the first reading of Ordinance No. 14 - 91 and dispense with the <br />reading. Council Member Bohjanen seconded the motion. <br />VOTING ON THE MOTION: <br />Bisel © Bohjanen <br />Neal © Reinert <br />El <br />Kuether <br />El <br />Abstained: none. <br />Motion carried unanimously. <br />PUBLIC HEARING, WARE ROAD IMPROVEMENT, DARRELL SCHNEIDER <br />Mr. Schneider explained that this proposed project was initiated <br />by a petition from more than 50% of the homeowners in the area <br />affected by the improvement. A feasibility study was ordered by <br />the Council on July 22, 1991 and the public hearing was set at <br />the October 14, 1991 Council meeting. The purpose of the public <br />hearing is to take comment from the affected property owners and <br />then to start the 60 day waiting period required by the City <br />Charter. No action can be taken this evening. <br />Mr. Schneider used the overhead projector and outlined the <br />proposed improvement. The estimated construction cost is <br />$154,650.15. The area and unit charges would bring the total <br />cost to $382,731.85. The estimated cost for a 100 foot lot would <br />be $12,450.00 plus $3,825.00 for upgrading Ware Road. Mr. <br />Schneider explained that the cost for upgrading Ware Road is <br />being included at this time, however the actual upgrading of Ware <br />Road may not occur for two (2) to three .(3) years. This would <br />eliminate the need to go back to these same property owners for <br />another assessment. Mr. Schneider explained that the assessments <br />proposed for the property along Ware Road are comparable to the <br />assessments in PineRidge Estates. <br />Mr. Schneider noted that the Clerk has received letter of <br />opposition to the improvement from James D. Rickard, 6361 Ware <br />Road, Ronald E. Vrnak, 6357 Ware Road and Edward A. Wiener, Sr., <br />6359 Ware Road. <br />PAGE 4 <br />
