1 <br />1 <br />1 <br />COUNCIL MEETING NOVEMBER 12, 1991 <br />Council Member Neal asked if the proposed improvement had been <br />handled in the normal manner. Mr. Schneider explained that a <br />landowner in the area had questioned how sewer and water <br />utilities could be extended along Ware Road. The landowner was <br />advised to get a petition signed by his neighbors requesting the <br />preparation of a feasibility study. A petition had been received <br />by the staff with more than one half of the affected property <br />owners signatures. However, the petition received by the staff <br />was for the installation of sewer and water utilities, not a <br />feasibility study. A feasibility study has been prepared and is <br />being presented this evening. <br />Mayor Bisel explained that the City Charter allows for the <br />hearing to be held this evening. If an affected property owner <br />does not want to be included in the improvement, he may sign a <br />petition requesting to be removed from the original petition. If <br />51% of the affected property owners are in favor of the <br />improvement, the improvement will be constructed and all affected <br />property owners will be assessed. If 51% of the property owners <br />do not want the improvement, the improvement will not be ordered <br />by the City Council. <br />Mayor Bisel opened the public hearing at 7:21 P.M. <br />Fred Ranallo, 6366 Ware Road explained that it was his <br />understanding that there were only 10 names on the petition and <br />there are 22 parcels of property involved. This means that less <br />than one half of the property owners want the improvement. Mr. <br />Ranallo noted that this petition was suppose to be for just the <br />study to determine the costs. He asked if the Council could at <br />this point say yes or no to the petition. Mayor Bisel said no, <br />the Council must wait 60 days to see if the affected property <br />owners wish to petition against the improvement. He noted that <br />the improvement cannot proceed unless at least 51% of the <br />property owners petition for the improvement. <br />There was confusion regarding how many signatures were needed on <br />a petition to request a feasibility study and how many signatures <br />were needed on a petition for the installation of utilities. The <br />City Attorney explained that the City Charter requires the <br />signatures of 25% of the affected property owners for a <br />feasibility study and 51% of the affected property owners for the <br />installation of the improvements. <br />Mr. Louis LeTendre, 6350 Ware Road noted that some of the homes <br />from PineRidge Estates face Ware Road. He asked if these <br />properties would count in the total number of properties required <br />on the petition for the improvements. Mr. Schneider explained <br />that these properties were not affected by this improvement since <br />they receive their utilities from the street in PineRidge. These <br />PAGE 5 <br />176 <br />
