Fr. September 23, 1974 ' 9 <br />1 <br />1 <br />The rezoning for Mr. Robert Nelson was called to order at 8:15 P.M. Mr. Harvey <br />Karth was here representing Mr. Nelson. This is a request to rezone from Ag- <br />Residential to Commercial - Limited Business. Mr. Locher read the affadavits of <br />publication and mailing list. <br />Mr. Marier reported that the Planning and Zoning Board had recommended approval of <br />this rezoning with stipulations. No storage of articles outside, proper off - street <br />parking and business to be started within one year. If not, zoning will revert to <br />the original zoning. <br />Mr. Karth felt these stipulations presented no problems. The only questions he <br />had was concerning the signs. He had finally reached someone at the State who <br />could answer his questions. The information he had received was that as long <br />as the sign is on private property and advertises the business located there, the <br />control reverts to the local municipalities. These signs would have to be approved <br />by the local governing body. <br />Mr. Karth assured the Council that the owner will follow all codes of this City. <br />Mr. Jaworski asked if there is to be any new construction and Mr.Karth said, No. <br />The only thing is the existing buildings will be remodeled and upgraded. <br />Mr.Marier moved to approve the rezoning with the stipulations as stated. Seconded <br />by Mr. McLean. Motion carried. <br />Mr. Marier moved to close the rezoning hearing at 8:30 P.M. Seconded by Mr. <br />Jaworski. Motion carried. <br />The next item on the agenda was consideration of the $180,000.00 bond issue. Mr. <br />Werner was here from Springsted to report on the progress of the sale. He reported <br />that an "A" rating had been received from Moody. This is the best rating in Anoka <br />County at the present time. BancNorthwest had bid on the bonds at 6.85762% interest. <br />Mr. Werner recommeded to the Council that a Resolution accepting this bid be <br />passed. He did not have the Resolution forms with him since the bid had come in so <br />late this afternoon. Mr. Locher did have the forms. <br />Mr. Jaworski moved to adopt a Resolution accepting the bid of BancNorthwest for the <br />$180,000.00 bond issues at an interest rate of 6.85762 %, interest to amount to <br />$51,775.00. Seconded by Mr. McLean. Motion carried. <br />Mr. Locher and Mr. Werner retired to the Clerk's office to complete the forms. <br />Mr. Marier returned to the report on the action of the Planning and Zoning Board. <br />The application of Mr. Charles Prokop and Mr. Jankus had been considered. Mr. <br />Prokop and Mr. Jankus were requesting a variance to Ordinance 22, Sec.'s 20,22 & <br />23. The Planning and Zoning Board had recommended approval of this request. Mr. <br />Marier so moved. <br />Mr. Zelinka asked if the cost of the Engineer checking this area would be paid by <br />the petitioners and was told, Yes. <br />IIIMr. Jaworski rdmelIered that the LaBudas were concerned about soil erosion of the <br />hillside where the street will be cut through. <br />Mr. Gotwald reported that he had checked the area this afternoon. There will be the <br />necessity of a catch basin and a culvert but this in known by Mr.Prokop, in fact <br />he had suggested it. Mr. Gotwald said the right -of -way is quite wide and he felt <br />
