All utilities or construction over existing utility service lines are subject to review and <br />approval by the City Engineer. <br />Grading and Drainage. A grading and drainage plan has been reviewed by the City Engineer (see <br />comments of City Engineer on Memorandum dated January 31, 2003 attached hereto as Exhibit I). <br />The drainage plan must be approved by the Rice Creek Watershed District. <br />Elevations. Pursuant to Section 1102.07, Subd. 2(B), structures must be placed with the lowest <br />floor three (3) feet above the ordinary high water level. The plans indicate that the ordinary high <br />water level for Reshanau Lake is 883.5 feet. The 100 year flood plain lies along the 886 foot <br />contour. The site plan indicates a first floor elevation for the proposed building addition of 896.14 <br />feet. <br />Development Agreement: Prior to the commencement of any site work, the applicant will be <br />required to enter into a development agreement with the City and post all the necessary securities <br />required by it. <br />Conditional Use Permit. As previously indicated, the applicant is requesting approval of a <br />conditional use permit to allow expansion of an existing church structure within the R -1, Single <br />Family Residential District. Religious institutions are conditional uses within the R -1, Single <br />Family Residential District. <br />In considering conditional use permit requests, the Ordinance states that the Planning and Zoning <br />Board shall recommend approval and the City Council shall order the issuance of such permit only <br />if it finds that such use at such location: <br />1. Will not be detrimental to or endanger the public health, safety, comfort, <br />convenience or general welfare of the neighborhood or the City. <br />Comment: The proposed use is not anticipated to be detrimental or endanger the <br />public. <br />2. Will be harmonious with the general and applicable specific plans and policies of <br />the comprehensive plan of the City and this ordinance. <br />Comment: The Comprehensive Plan suggests public /semipublic use of the site. <br />The Comprehensive Plan contemplates churches within the public /semipublic land <br />use designation. Thus, the proposed land use is harmonious with the land use <br />directives of the Comprehensive Plan. <br />3. Will be designed, constructed, operated, and maintained so as to be harmonious <br />and appropriate in appearance with the existing and/or intended character of the <br />general vicinity and will not change the essential character of that area. <br />
