1 <br />September 26, 1977 <br />he would be out of town as will Mr. Gotwald. He asked for authorization to reset the <br />date. Mr. McLean so moved. Seconded by Mr. Schneider. Motion carried unanimously. <br />Mayor Bohjanen introduced Mr. Paffel, who is interested in a lot in Otter Lake Estates. <br />Mr. Paffel wants to build a split entry duplex with a 20x40 pole bulding on the lot. <br />He asked for a Council opinion on this matter. <br />Mayor Bohjanen said this must go through the Planning and Zoning and Mr. McLean pointed <br />out that the plat has not been signed and cannot be filed until all matters are cleared. <br />This is an Ag district and as such, is zoned R -I. In order for a two family home to be <br />constructed in that area, it would need to be re -zoned to R -2. <br />The lot Mr. Paffel is considering is Lot 3, Block 1, near 64th Street. <br />Mr. Locher said there are some minor changes that must be made by the surveyor before <br />the County Surveyor will record the plat. This lot would have to be re -zoned for R -2 <br />and that calls for a public hearing with publication 10 days prior to the hearing and all <br />persons within 300' of the property must be notified. It was felt that nothing could be <br />decided on this matter until the regular meeting scheduled for November 14, 1977 at the <br />earliest. <br />Mr. McLean asked who should make the application for re- zoning - Mr. Locher said application <br />may be made by the Council, the Planning and Zoning, property owner or a resident; in this <br />case - the property owner. <br />III Mr. Paffel asked about a special meeting and Mr. McLean felt there are some special meet- <br />ings scheduled and this possibly could be considered at one of those meetings. However, <br />the Planner's recommendation must be submitted before consideration. <br />Mayor Bohjanen introduced Mr. Jerry Beach, Tree Inspector, who explained his suppested <br />program for the use of Ammate for the control of Oak Wilt. After some discussion on the <br />method of use and control, Mr. Karth moved to approve the expenditure of $750.00 for this <br />purpose. Seconded by Mr. McLean. Motion carried unanimously. <br />Mr. Karth reported that all the money for the improvements on West Shadow Lake Drive is <br />in expept for two persons and he felt these would be in tomorrow. <br />In connection with this street, Mr. Schneider asked who controls the expiration of bonds <br />and letters of credit? <br />Mr. Locher said in this case, the project had faltered and by mutual agreement, the matter <br />had been let expire. Mr. Locher said the only time a City can use the bonded amount is <br />when the developer is bankrupt, and this was not the case at the time of expiration. <br />Mr. McLean felt this is an administrative function and he suggested that the Attorney <br />maintain this file and be responsible for alerting the Council as to the expiration <br />of these documents. Mr. McLean so moved. Seconded by Mr. Schneider. Motion carried un- <br />animously. <br />Mr. Schneider requested the Clerk to have the tickler file set up and in operation by Nov - <br />ember 1, 1977. Mr. Schneider so moved. Seconded by Mr. Karth. Motion carried unanimously. <br />Mr. Karth reported that the Ford Squad Car has an engine problem - there is a thrown <br />rod and a bent crankshaft - all the bills are not ina as yet, so the total cost is not <br />available at this time. <br />
