1 September 26, 1977 he would be out of town as will Mr. Gotwald. He asked for authorization to reset the date. Mr. McLean so moved. Seconded by Mr. Schneider. Motion carried unanimously. Mayor Bohjanen introduced Mr. Paffel, who is interested in a lot in Otter Lake Estates. Mr. Paffel wants to build a split entry duplex with a 20x40 pole bulding on the lot. He asked for a Council opinion on this matter. Mayor Bohjanen said this must go through the Planning and Zoning and Mr. McLean pointed out that the plat has not been signed and cannot be filed until all matters are cleared. This is an Ag district and as such, is zoned R -I. In order for a two family home to be constructed in that area, it would need to be re -zoned to R -2. The lot Mr. Paffel is considering is Lot 3, Block 1, near 64th Street. Mr. Locher said there are some minor changes that must be made by the surveyor before the County Surveyor will record the plat. This lot would have to be re -zoned for R -2 and that calls for a public hearing with publication 10 days prior to the hearing and all persons within 300' of the property must be notified. It was felt that nothing could be decided on this matter until the regular meeting scheduled for November 14, 1977 at the earliest. Mr. McLean asked who should make the application for re- zoning - Mr. Locher said application may be made by the Council, the Planning and Zoning, property owner or a resident; in this case - the property owner. III Mr. Paffel asked about a special meeting and Mr. McLean felt there are some special meet- ings scheduled and this possibly could be considered at one of those meetings. However, the Planner's recommendation must be submitted before consideration. Mayor Bohjanen introduced Mr. Jerry Beach, Tree Inspector, who explained his suppested program for the use of Ammate for the control of Oak Wilt. After some discussion on the method of use and control, Mr. Karth moved to approve the expenditure of $750.00 for this purpose. Seconded by Mr. McLean. Motion carried unanimously. Mr. Karth reported that all the money for the improvements on West Shadow Lake Drive is in expept for two persons and he felt these would be in tomorrow. In connection with this street, Mr. Schneider asked who controls the expiration of bonds and letters of credit? Mr. Locher said in this case, the project had faltered and by mutual agreement, the matter had been let expire. Mr. Locher said the only time a City can use the bonded amount is when the developer is bankrupt, and this was not the case at the time of expiration. Mr. McLean felt this is an administrative function and he suggested that the Attorney maintain this file and be responsible for alerting the Council as to the expiration of these documents. Mr. McLean so moved. Seconded by Mr. Schneider. Motion carried un- animously. Mr. Schneider requested the Clerk to have the tickler file set up and in operation by Nov - ember 1, 1977. Mr. Schneider so moved. Seconded by Mr. Karth. Motion carried unanimously. Mr. Karth reported that the Ford Squad Car has an engine problem - there is a thrown rod and a bent crankshaft - all the bills are not ina as yet, so the total cost is not available at this time.
