September 11, 1978 <br />Mr. Tippel if he bred pigeons for sale and Mr. Tippel said, No, he had never sold a <br />pigeon. <br />Mayor Karth asked how the unwanted birds were disposed of and Mr. Tippel said, they <br />are either given away or killed. <br />Mr. Kulaszewicz felt the ordinance should be rewritten and specific definitions <br />set as to what this applies. <br />Mr. Zelinka wondered if there is a need for a special use permit - could a matter <br />such as this be handled in this manner in the future? What alternative motions could <br />be made to solve this matter? <br />Mayor Karth said the motion could be for enforcement of the ordinance requiring <br />5 acres or more for the keeping of more than two of any species of animals; or, <br />requiring the pigeons to be removed; or, grandfather them in, with restrictions as <br />to the number; of, leave as is. <br />Mr. Schneider asked Mr. Tipple howmany birds he had at one time and Mr. Tipple said <br />the number is governed by the number of birds the building would handle. In the <br />Spring and Summer there are more birds - in the Fall and Winter, fewer birds. Mr. <br />Schneider asked how many birds his building would contain and Mr. Tipple said there <br />are 125 perches. <br />Mr. Schneider moved to allow Mr. Tipple to keep the pigeons with no nore than 100 <br />birds at any one time, with no increase to be made in the size of the bird loft. <br />Seconded by Mr. Zelinka. Motion declared passed, with Mr. Kulaszewicz abstaining. <br />Mr. Locher arrived at 9:30 P.M. <br />Mr. McLean asked Mr. Locher to formulate an ordinance on the matter of dealing <br />with future pigeon operatoons. <br />Mr. Locher was questioned on the legality of the receipt of the bid for the storage <br />building and he said it was an acceptable bid. <br />Mayor Karth said an Ordinance will be drafted and a public hearing will be set for <br />the consideration of this ordinance and all persons will be heard at that hearing. <br />Mr. Terry Nelson was in the audience and requested permission to move a drainage <br />easement from between Lots 21 & 22 to between Lots 19 & 20 on West Shadow Lake Drive, <br />in Lakes Add. #1. <br />The Clerk reported that Mr. Gotwald had called. He has inspected the site and found <br />the new location to be more suitable for a drainage easemet and had recommended <br />approval of this request. Mr. McLean moved to approve this change. Seconded by <br />Mr. Kulaszewicz. Motion declared passed. <br />Mr. Locher said the original easement must be vacated and this requires a hearing. <br />The new easement location must have a legal description and be dedicated to the City. <br />Mr. Locher will take care of the publication and the drafting of notices. <br />Mr. McLean moved to set the hearing for October 10, 1978 at 9:00 P.M. Seconded by <br />Mr. Zelinka. Motion declared passed. <br />The temporary mining permit issued to Mr. Le Roux has expired and some action must <br />be taken on this matter. The Clerk is to call Mr. Gotwald and call the Council members <br />with his recommendations. <br />
