184 <br />November 13, 1978 <br />The problems with hunters was discussed in general. Mr. Peter Scherer <br />asked what is needed by the City in order to ban all hunting. He felt that <br />homes have filled the area to the point where not hunting should be allowed. <br />Mr. Schneider felt that something definite should be set up before the next <br />hunting season. He suggested setting an open meeting for discussion of <br />both pro and con on this subject. After some discussion, Mr. Schneider <br />moved to set an open meeting for discussion of the hunting problem for <br />February 12, 1979 at 9:00 P.M. Seconded by Mr. McLean. Motion declared <br />passed. <br />The Public Hearing on Carole's Estates II was called to order at8 :45 P.M. <br />Mr. Lcoher read the notice of legal publication. Mr. Tramm presented a <br />letter from the Rice Creek Watershed Board that he had picked up this date. <br />Mr. Tramm presented the Council with a revised copy with all the suggested <br />changes incorporated. Mayor Karth questioned the commercial designation on <br />the lots bordering Old Highway #8, will this extend into the lots abutting <br />the rear of these commercial lots? On consulting the map, it was found <br />that it would not. <br />There was some discussion on the problems being created by the ponding <br />areas. It was felt the requirement for these ponding areas is changing <br />the water table and creating a problem for the home owners in that there <br />could be a problem with water in basements. The ponding areas are being <br />required by the Rice Creek Watershed Board and no provisions are being made <br />for the maintenance of these areas. Mr. Moble felt that the number of <br />these ponding areas being required in all the plats now in the process <br />of being developed will cause future problems in this City. <br />Since this plat has the approval of the City Engineer, Mr. McLean moved <br />to approve the plat, with money to be received for parks in the amount of <br />$3,850.00 before the signing of the final plat and lots 12 through and <br />including 21 have a commercial notation on the deeds. Seconded by Mr. <br />Kulaszewicz. Motion declared passed. <br />Mr. McLean felt that Mr. Mobley has a valid point on these ponding areas <br />and felt that this Council should meet with a representative from that <br />Board and discuss the problem. The Clerk was asked to contact the Rice <br />Creek Watershed Board and set a special meeting as soon as possible. <br />Mr. McLean moved to close the hearing at 9:05 P.M. Seconded by Mr. <br />Kulaszewicz. Motion declared passed. <br />Mr. Bob Peterspn presented the Council with petitions signed by property <br />owners in Lakes Addition #2 plat for the extension of the sewer, water, <br />storm sewer, streets, curbs and gutters. <br />Mr. McLean asked what percentage of the overall plat does these signatures <br />represent and Mr. Peterson wasn't sure. These petitions are not dated. <br />Mr. McLean asked Mr. Peterson to indicate the lot /lots owned by the person <br />signing the petition have the documents dated. Mr. Peterson agreed to <br />do this. <br />Mr. McLean also felt that if a feasibility study is ordered for this <br />project and the project is not done, then the cost of this study should <br />be paid for by the persons signing the petition. Mr. Peterson was advised <br />to check with Mr. Gotwald on the approximate cost for a feasibility study. <br />
