There had been no further information from Mr. Rivard on the special <br />use permit for the keeping of chickens. <br />..Mr. Boyle had applied for a variance byt a variance to the property <br />had already been issued. His refund of $25.00 is in the checks to be <br />approved. <br />..Mardon Homes had applied for a cariance to construct smaller homes <br />than allowed by City Ordinances. This was held due to lack of information. <br />.. Mr. Bloom's plat on 20th Avenue must be redesigned. There were <br />several suggestions from the Planning adn Zoning which will be forwarded <br />to the Engineer. <br />Mr. Gotwald said it is necessary to have preliminary plat approval from <br />this City before the plat can be forwarded to the Rice Creek Watershed <br />Board. He felt there will be some problems with the ponding requirements. <br />It may be necessary to cut the number of lots. <br />The hearing on Deer Pass Trail was called to order at 9:00 P.M. Mr. <br />Locher read the notice of legal publication and the list of mailed notices. <br />The cost figure in this notice was $8,478.00. <br />Mr. Gotwald gave a brief history of the status of that street and listed <br />three ways in which this matter can be handled; 1) assess all property <br />owners; 2) asses only the property abutting Deer Pass Trail with the <br />exception of Mr. Prokop; and 3) forget the whold matter. Mr. Gotwald <br />presented the various cost figures for the ways in which this could be <br />assessed. <br />Mayor Karth asked if the present street would be harmed by the extra <br />traffic created the the new home being constructed and Mr. Gotwald said <br />regular car traffic does not harm the street surface - the heavy trash <br />trucks or school busses could cause problems in the Spring. <br />Mr. McLean asked about the condition of the street at the present and <br />Mr. Gotwald said there is one spot that will need some routine main- <br />tenance, but there has been no real damage to the street. <br />Mayor Karth asked for questions from the audience and Mr. Wayne Ellison <br />asked if the 2nd method included his extension and Mr. Gotwald said, No. <br />He then asked if he would be involved in the upgrading of Deer Pass Trail? <br />At the last meeting on this matter he had asked this question and had <br />been told No. He wanted to know if he is still being considered for <br />assessments. <br />It was explained that all persons had been notified. According to State <br />Law, names may be deleted from an assessment list, but not added if they <br />have not been notified of the hearings. <br />The original agreement had been two building permits only until the <br />street was brought up to City specifications - Mr. Gotwald felt this <br />agreement was slanted toward the platted lots abutting Deer Pass Trail. <br />The new homes have been constructed on estension of that street. <br />Mr. LaBuda, owner of the remaining lots was in favor of leaving the <br />street as is. Mr. McLean asked, if these lots are sold, can the <br />obligation be assigned and Mr. Locher said, Yes. Mr. Gotwald said this <br />
