This <br />would tie up City funds, but interest could be charged back to the <br />owner. <br />Mr. Gotwald suggested getting an estimage from the City contractor and <br />from and outside contractor. Mr. McLean moved to continue this hearing <br />until August 13, 1979 at 9:45 P.M. Mr. Gotwald to have the new <br />estimates for that hearing. Seconded by MR. Kulaszewicz. Motion <br />declared passed. <br />The hearing for the rezoning of Baldwin Lake Trailer Court was called <br />to order at 9:40 P.M. Mr. Locher read the notice of legal publication <br />and the list of persons to whom mailed notices were sent. There were <br />three returned with no forwarding address. <br />Mr. Locher explained this rezoning includes the existing portion of <br />the Park. It was explained this was done in order to tie the park <br />together in one zoning ordinance. The complete area is to be rezoned <br />to R -6, thus eliminating any commercial zoning of the lands. <br />There was discussion of the court prividing screening to the North <br />but it was explained this is a zoning hearing - these matters can be <br />discussed at the hearing on the proposed layout of the park. <br />Mayor Karth asked for comments from the audience and the Council on the <br />proposed rezoning and there was none. Mr. McLean moved to approve the <br />rezoning of the lands per the legal description to R -6, Mobile Home <br />Park classification. Seconded by Mr. Zelinka. Motion declared passed. III <br />Mr. McLean moved to close the hearing at 10:10 P.M. Seconded by Mr. <br />Kulaszewicz. Motion declared passed. <br />Mr. McLean continued his Planning adn Zoning Board report: <br />..The Board had recommended approval of the layout for the expansion <br />of the Baldwin Lake Trailer Park. Mr. McLean moved to set a public <br />hearing for this project for August 27, 1979 at 8:30 P.M. Seconded by <br />Mr. Kulaszewicz. Motion declared passed. <br />..The East Birch Addition had been considered but no action had been <br />taken. Some suggestions had been outlined by the Planning and Zoning <br />and these had been forwarded to the developer. <br />..The matter of the Quads and the rezoning for NorthNorth East Realty <br />had been discussed. Mr. McLean read portions of the minutes pertaining <br />to the discussion of that proposal. <br />Mr. McLean questioned Mr. Locher on the requirements of voting to pass <br />a rezone. Mr. Locher said the Stat Law says 2/3's vote of all members. <br />Mr. McLean said the Planning adn Zoning vote had ended in a tie so <br />therefore, there is no recommendation from that Board. He felt there <br />is no point in sending this back to that committee for more study since <br />all things have been presented, in one form or another. <br />Mr. McLean felt hat each side is going to have to bend a little in <br />this matter. Mr. Zelinka felt that requiring Mayor Karth to abstain <br />from voting in this matter is cutting the 'conflict of interest' <br />too thin. Mr. Locher was requested to check this with the Attorney <br />General. <br />Mr. McLean said this Council has three choices 1) send back to Planning <br />and Zoning; 2) set a public hearing; 3) Council meet with both <br />
