1 <br />1 <br />1 <br />COUNCIL MINUTES MARCH 11, 1991 <br />Mr. Miller explained that the pideliminary plat for the single <br />family residences was approved by the Council on January 14, <br />1991. This preliminary plat is for the town homes. He explained <br />that the plat contains approximately 19 to 20 acres and 75 town <br />homes are proposed for the area. The plat has been reviewed by <br />the DRB and the Park Board and all items are resolved and both <br />boards recommend approval. Mr. Miller noted that one concern of <br />the developer is whether the improvements should be privately or <br />publicly installed. This matter will be considered after the <br />public hearing. <br />Mayor Bisel opened the public hearing at 7:14 P.M. There was no <br />one in the audience to speak for or against the proposed <br />preliminary plat. Mr. Hawkins explained that he had received a <br />copy of town home association by -laws today. He noted that they <br />must be approved and the developer's agreement must be completed <br />prior to the approval of the final plat. <br />Council Member Bohjanen moved to close the public hearing at 7:16 <br />P.M. Council Member Neal seconded the motion. Motion carried <br />with Council Member Kuether abstaining. <br />Council Member Bohjanen moved to accept the preliminary plat of <br />Wenzel Farms Town Homes contingent upon the comments of the DRB. <br />Council Member Neal seconded the motion. On a roll call vote, <br />motion carried with Council Member Kuether abstaining. <br />Mr. Miller addressed the matter of private versus publicly <br />installed improvements. He noted that on October 8, 1990 the <br />Council took action that would no longer allow developers to <br />install their own improvements unless the Council gave <br />authorization prior to the preliminary plat approval. Mr. Miller <br />noted that the City is currently involved in litigation with one <br />developer regarding his developer installed improvements. Mr. <br />Schneider noted that there have been problems with three (3) of <br />the last four (4) developer installed improvements. Mr. Miller <br />recommended that improvements be installed publicly for the <br />Wenzel Farms development. <br />Council Member Reinert said there was considerable reason for <br />developing this policy and moved to continue the established <br />policy as outlined in the October 8, 1990 Council minutes. <br />Council Member Bohjanen seconded the motion. Council Member <br />Bohjanen asked if there was a difference in the cost of the <br />improvement. Mr. Miller explained that if the developer installs <br />the improvement as the City would, the costs would be similar. <br />He noted that if the improvements are done publicly, the interest <br />rate on the bonds are likely to be lower than what the developer <br />can borrow for. However, the construction may be quicker if the <br />improvements are developer installed. <br />PAGE 5 <br />007 <br />
