1 <br />1 <br />1 <br />COUNCIL WORK SESSION FEBRUARY 19, 1992 <br />he had a problem with the way the matter was handled. <br />Mayor Reinert explained that at the January 6, 1992 Special <br />Council Meeting, he asked that several items be pulled from the <br />appointment list and it was his intention that these items would <br />be reviewed. He noted that maybe the matter did not move through <br />the process as it should have. <br />DEVELOPMENT ISSUES, DARRELL SCHNEIDER <br />Mr. Schneider explained that there will be no development items <br />on the February 24, 1992 agenda. He reviewed the following <br />items: <br />Ebensteiner, Black Duck Estates, Phase I and Phase II - <br />Elevations are currently being taken on this proposed <br />development. Letters have been sent to residents regarding the <br />surveying and this matter will be placed on the March 9, 1992 <br />agenda. The drainage system that is being developed will be an <br />improvement for the entire neighborhood. <br />Mr. Schumacher noted that there has been 100% cooperation from <br />the developer. When this matter reaches the Council there will <br />be no loose ends and the developer has done everything that he <br />has been asked to do. <br />Mr. Ebensteiner suggested that the City consider the following <br />policy: <br />Allow developer to install his own improvements provided <br />that he agrees to allow the City Engineer to prepare the <br />design and perform the inspections. The developer would <br />directly contract with the contractor. The City maintains <br />control and has influence regarding the selection of the <br />contractor. The Staff will draft the developers agreement, <br />not the City Attorney and this will give the City better <br />control of an improvement. The procedure will be more <br />expedient since the City will not have to go through the <br />bonding or bidding procedure. The City will require a <br />letter of credit in the amount of 150% of the total cost of <br />the improvement. <br />Mayor Reinert asked if a contractor could claim discrimination? <br />Mr. Schumacher explained that the City would not be employing or <br />making a decision on who is the contractor. <br />Shores of Marshan Lake - There are many issues to resolve on this <br />proposed improvement. The zoning is currently R -3, Medium <br />Density Residential. It is proposed to rezone the area to R -1, <br />Single Family Residential.
