Council Member Kuether moved to table consideration of
Ordinance No. 11 - 95. Council Member Bergeson seconded the
motion. Motion carried unanimously.
SECOND READING, Flood Plain Management Ordinance, No. 12 - 95 -
Ms. Wyland explained that a four - fifths vote is required for
adoption of this Ordinance and asked that action on the Ordinance
be tabled until the next City Council meeting. Council Member
Kuether moved to table consideration of Ordinance No. 12 - 95.
Council Member Bergeson seconded the motion. Motion carried
unanimously.
Council Member Kuether asked if there was anything in this
Ordinance addressing ditch cleaning. Mr. Powell said no, however
the Rice Creek Watershed District has been giving a lot of
attention to ditch cleaning. It is their number one issue.
SECOND READING, Ordinance No. 13 - 95 Amending the Sign Ordinance
- Ms. Wyland explained that the City Attorney who is working on
the Adam's Sign lawsuit has discovered an inconsistency in the
Amended Sign Ordinance and the original Sign Ordinance contained
within the City Code. This discrepancy relates to the numbering
of certain sections and subdivisions of the Ordinance, not the
content of the Ordinance. The recently amended Ordinance must be
formatted to be consistent with the ordinance in the City Code.
The Sign Ordinance provided in the City Council packets reflects
this correction. City Staff is recommending approval of the Sign
Ordinance as submitted.
The Sign Ordinance Amendment was originally approved by the
Planning and Zoning Board and City Council on March of 1995. The
purpose was to eliminate advertising signs in all zoning
districts except the Rural and Rural /Business Reserve District.
The City Council approved the FIRST READING of this Ordinance No.
13 - 95 at their June 26, 1995 meeting.
Council Member Bergeson moved to adopt the SECOND READING of
Ordinance No. 13 - 95 and dispense with the reading. Council
Member Kuether seconded the motion. Motion carried unanimously.
PAGE 5
1
1
