1 <br />1 <br />1 <br />COUNCIL MEETING JULY 10, 1995 <br />Ordinance No. 13 - 95 can be found at the end of these minutes. <br />Consideration of Resolution No. 95 - 83 Setting Public Hearing to <br />Vacate Drainage and Utility Easements Between Lots 2, Block 1 and <br />Lot 3, Block 1, Apollo Business Park - Ms. Wyland explained that <br />the City Council recently approved a minor subdivision to replat <br />Lot 2 and Lot 3, Block 1, Apollo Business Park for construction <br />of the Nol -Tec, Inc. facility. A drainage and utility easement <br />was originally platted around the perimeter of both lots. The <br />easement must be vacated where Lot 2 and Lot 3 meet since it <br />serves no useful purpose and encumbers the property. <br />The City is required to adopt a resolution setting a public <br />hearing to discuss the proposed vacation. Resolution No. 95 - 83 <br />set July 24, 1995, 6:30 P.M. for the public hearing. Notice has <br />been placed in the legal newspaper and abutting property owners <br />will be notified as required by State Statute. <br />Council Member Kuether moved to adopt Resolution No. 95 - 83. <br />Council Member Bergeson seconded the motion. Motion carried <br />unanimously. <br />Resolution 95 - 83 can be found at the end of these minutes. <br />Consideration of Resolution No. 95 - 84 Setting a Public Hearing <br />to Vacate Trail Easement, Shores of Marshan Lake - Ms. Wyland <br />explained that the developer of the Shores of Marshan Lake re- <br />aligned the originally platted trail and constructed a boardwalk <br />through the development. To facilitate this construction, the <br />City agreed to vacate portions of the existing trail upon <br />completion of the boardwalk trail and submittal of necessary <br />easement documents covering those sections of trail. <br />The City is required to adopt a resolution setting a public <br />hearing to discuss the proposed vacation. Resolution No. 95 - 84 <br />establishes July 24, 1995, 6:30 P.M. for the public hearing. <br />Notice has been placed in the legal newspaper and abutting <br />property owners will be notified as required by State Statutes. <br />Council Member Kuether moved to adopt Resolution No. 95 - 84. <br />Council Member Bergeson seconded the motion.
