I f we grant var- <br />iances in cases such as this, then he felt that our Ordinance is wrong. <br />Mr. Jaworski asked Mr. Locher if the Counci I would be setting a precedent <br />or is each case considered on an individual basis. <br />Mr-. Locher sai d that each request must be considered indi vi dually. <br />Mr. Cardinal moved to grant a variance to Mr. Henry Speiser on the <br />property described as fol lows: <br />That part of the Northwest 4 of the Southwest 4 of Section 29, <br />Township 31, Range 22, Anoka County, Minnesota described as fol lows <br />to -wit: Beginning at a point of the South line of said Northwest <br />4 of the Southwest 4 distant 744 feet East from the Southwest <br />corner thereof; thence North along the line parallel with the <br />West I i ne thereof a distance of 208.7 feet; thence East pa ra I I e I <br />with the South line thereof a distance of 208.7 feet; thence South <br />parallel with the West line thereof a distance of 208.7 feet to <br />the South line of said Northwest 4 of the Southwest 4; thence <br />West along the South line thereof a distance of 208.7 feet to <br />the point of beginning. <br />providing that the land passed a perc test. The reasons being that this <br />is the only parcel that he owns and he is not landlocking any other <br />lands. Motion was seconded by Mr. Jaworski. Motion carried with Mr. <br />Marier voting, No. <br />Mr. Marier reported that Mr. Leo Hager-, who owns land on Bald Eagle <br />Blvd. had appeared asking for a variance for 350' of land he owns. He <br />would like to split the land and give 150' to a relative for the pur- <br />ose of building a home. The P &Z had recommended that the request be <br />denied. Mr. Hager was not present at the Council meeting, so Mr. <br />Jaworski moved to table this request until the next Council meeting and <br />have the Clerk contact Mr. Hager and ask him to be present. Seconded <br />by Mr. Cardinal. Motion carried. <br />Mr. Marier reported that Mr. Donald Allen had appeared before the P &Z <br />asking for a sanitary landfi II for property he owns near Hol ly Drive and <br />12th Avenue. He had bought the property to be used for the running of <br />cattle but now finds that it is too low. He had contacted the County <br />and they had referred him to the ViIlage. He was told that he must <br />first go through the Anoka County Health Department, the Rice Creek <br />Watershed Board and the PCA. Mr. Marier had given him the names of <br />people to contact and he will report back to the Council. Mr. Marier <br />felt possibly Mr. Allen had bought the land sight unseen. He also <br />felt that Mr. Allen wanted the correct information in order to the <br />job right. <br />Mr. Roy Stanley had also appeared with a preliminary plat. The P &Z <br />had requested that the Counci I set a date for a hearing. Mr. Cardinal <br />moved to set April 18, 1973 at 8:30 P.M. for the hearing before the <br />P &Z and April 23, 1973 at 8:30 P.M. for the hearing before the Council. <br />Seconded by Mr. Marier. Motion carried. <br />
