March 25, 1974 Mr. Jaworski questioned the addition on the bill to Berghorst for the power outage. The Clerk had made a mistake in addition and the company has a $10.00 refund coming. Mr. Zelinka moved to refund this money. Seconded by Mr. Jaworski. Motion carried. Mr. McLean suggested on future billings such as list that a burden rate apply. He asked the Clerk to check with Mr. Hill for guidenance on this. Mr. Zelinka moved to approve bills #5661 through #5678 inclusive. Seconded by Mr. McLean. Motion carried. Mr. Zelinka moved to approve payroll checks #2253 through #2379 inclusive. Seconded by Mr. Marier. Motion carried. Since Mr. Locher had not arrived, the Council called a recess until such time. The meeting was reconvened at 10:15 p.m. Mr. Locher read a letter from Dave Torkildsen saying that basically the County Commissioners and the City Council agree on the Open Space concept except for parcel 2A which is the piece of land bordering Centerville Lake and located between the Kohler and Liebel homes. The County Park Department wants to condemn this parcel and the City disagrees. They also disagree on the approximately 342 acres comprising the golf course. Mr. Locher understood that the road to the Kohler home would be left. Mr. Marier asked Mr. Locher if he had had time to compare this Resolution with the first.one. Mr. Locher said this resolution was based upon their porposal but is basically the same. Mr. Marier questioned the meaning of Part 2 on page 2. His understanding on this paragraph was if there is one change on either to County Board or the City Council, then neither body is bound by this agreement. He asked Mr. Locher if this were true. Mr. Locher said, Yes. He said this agreement is more moral than legal but felt that it was as binding as it could be. There was discussion on this subject. Mr. Zelinka felt that future boards would hold to this Resolution. Mr. McLean felt the most important thing to do is get Legislative action to repeal the right of imminent domain of Anoka County. There were several places where "the City of Lino Lakes" should be inserted. Mr. Locher read the Appendix which set the rules for the operation of this Park. There was the suggestion of changing several words which Mr. Locher will take care of. Mrs. Borovansky asked how close this Park would come to their home. Is the area platted for Lakes Add. #3 left out of the Park? Mr. Locher said, Yes the platted areas were not included. He reported that the County Commissioners would meet Tuesday Morning at 9:30 a.m. for discussion of this agreement. Would any of the Council members be able to attend this meeting? Mr. Marier thought he could be there by 9:30 a.m.
