6/28/71 <br />Mr. LaMotte inquired about the outlot in LaMotte's Second,Addition pertaining to <br />straightening the ditch to run directly into the creek; he.noted that he had no <br />authority to cross the St. Paul Water Dept. property. Mr. L'Allier asked Mr. <br />Rosengren to consult with Mr. Gotwald on this., Mr. LaMotte was willing to go along, <br />with any costs involved with the ditch. <br />Tom Caron was asked to come forward by Mr. Cardinal. Mr. Caron was concerned <br />about the hayroad on which Jesse Heller had been allowed to place a culvert. The <br />plat map was viewed, showing an easement on the Caron property. W. Caron wants <br />to place a fence along the road with access gates, but wished to know which side <br />of the easement the posts should go on. After discussion, Mr, Bohjanen moved to <br />have the Clerk check the records on the hayroad as well as the thoroughfare map <br />to see if this was a dedicated road. Seconded by Mr, Cardinal. Carried unanimously. <br />o <br />Mr. L'Allier noted that unless we were cutting someone off, we should consider <br />vacating the hayroad. The matter will be placed on the next agenda if the Clerk <br />has time to find the information in the records; also, to let, Tom Caronoknow if <br />it is on the agenda. <br />At. 8:30 P.M., Mayor L'Allier adjourned the regular meeting and called to order the <br />hearing for the second rezoning for Keith Apitz. Mr. Locher read through the <br />affidavits of publication, mailing and posting and noted that they were all in <br />order. Redommending letters from Mr. Van Housen >end Mir. Gotwald were read, as <br />were the P&Z minutes regarding their recommendations. Mr. Apitz was asked to read <br />over the recommending letters. Mk.. Apitz stated that State law requires a service <br />station to have one restroom if there is hired help, but he had no plans to hire <br />anyone at this time. However, he planned to make provisions for future hook -up <br />to the interceptor. He was advised that the Metro. Council had passed the inter- <br />ceptor with stipulations concerning the zoning plan and elimating additional <br />hookups in Lino Lakes for some time. Also, our plumbing ordinance requires <br />stubbing anyway. Mr. Cardinal reminded Mr. Apitz that he had been told here that <br />one person couldn't hook up, but that hookup was done on an area basis. <br />Mr. Apitz stated that he would like to leave most of the existing trees on the <br />East side of the lo# and would put some on the line where there aren't any. He <br />stated that he would like to plant trees and grass on the West area of, crushed., <br />rock on the plans since he doesn't want cars that close to his house anyway. He stated <br />that he would prefer blacktop to crushed rock, but would like to do the back area later. <br />He noted also that he will have to fill in the front and would like to fill in the ditch <br />also; he was advised to contact the County on the ditch. Mr. Rosengren felt there would <br />be no problem with placing a culvert for the blacktop driveway. <br />Mr. L'Allier asked Mr. Apitz if he had any objections to making all the corrections <br />indicated by the Planner, Engineer and the P&Z if we allowed him to delay blacktopping <br />the rear area for six months,; he stated that he did not. Mr. Jaworski felt that <br />Mr. Apitz should be given a year to do the blacktop; Mr. Bohjanen, thought the time <br />should be until the next blacktopping season. <br />Mr. Cardinal moved to grant the rezoning to Keith Apitz under Ordinance, No. 6T(a), <br />allowing him one year maximum to blacktop the. back portion, providing that Mr. <br />Apitz make new plans including all the corrections indicated by the Planner, the <br />Engineer, and the P&Z, and that the new plans be resubmitted to the Planner and <br />the Engineer soon; also that, the Clerk send Mr. Apitz copies of the letter with the <br />necessary corrections to be made. Seconded by Mr. Bohjanen. Mr. L'AIlier.,felt <br />that the motion should contain the stipulations that Mr. Apitz conform with all the <br />recommendations of the Planner, Engineer, and the P&Z, and that same be indicated <br />on the plans, that he finish the blacktopping no later than January 1, 1972, and that <br />e new East setback line (10 additional feet covered with trees) be shown.
