7/26/71 <br />in it it was a public road. Mr. Cardinal replied that 12th Avenue wasn't much of a <br />road until Norm Miller moved in, so that they held to one in the other way. Mr. <br />Scherer noted that the rest of East. Holly was in the same shape as the bad part before <br />Grygelko's moved in; however, the bad part is no problem since everyone has a way out. <br />Mr. Cardinal stated that it was simply a shortcut. <br />After further discussion, Mr. Locher suggested that the first step would be to refer <br />the book to the Engineer to see if the road is where it is described to be, and <br />thought it would be a good idea if he checked all the roads in the book. He noted <br />that ,there was an award,of damages to the signers of the petition and that section <br />corner markers are mentioned. Mr. Cardinal stated that he doubtedithat the road- <br />way had changed except to straddle holes since there had always been fences along <br />it on both sides. He stated,that,he bad seen a later mep showing the road cutting. <br />across Ralstead's place. He felt, that it should be referred to the Engineer for a <br />report. <br />Discussion turned to the Caron hayroad which was scheduled later on the agenda. The <br />Clerk had found the laying out of this road also in the same book as well as a note <br />in the minutes that Don Paul and Jesse Heller had come to a meeting in 1964 to discuss <br />their private road. Mr. Locher read the description of the road, which runs on the N-S <br />quarter- section line from the NE corner of the SW 1/4 of $W 1/4 of Section 10 to its <br />intersection with the St. Paul and Kettle River Road (now Main St.) Mr. Rosengren noted <br />that the jog in the toad at its North end was due to a waterhole. Mr. Locher stated <br />that Mr. Caron would be safe if he put the fence 16 1/2 feet off the quarter section <br />line. Mr. Caron stated that he wanted.to fence his property so that his cattle could <br />graze and thus eliminate a fire hazard. Mr. Locher stated that the Village could <br />consider abandoning the road but other parties have a.right'to be heard., Mr. Locher <br />noted also that several pages of the.book were missing. <br />After discussion, Mr. Bohjanen moved to have the Engineer check the book and to find, <br />the correct lines for the 2 roads in question above. Seconded by llir. Cardinal. <br />Carried unanimously. <br />Mr. Cardinal reported that Mr. Pete Nadeau had asked for.a variance on a piece of land <br />on Birch St., which had provoked lots of discussion at the P&Z. Mr. Nadeau wants to <br />put in drain tile since the land is low to the North of this piece. Mr. Nadeau stated <br />that there was a natural waterway directly West of his piece, and that even if he split <br />off a bigger piece the house would still have to go in the same place. After discussion, <br />Mr. Cardinal moved to grant Pete Nadeau a variance, with the stipulation that Mr. • <br />Gotwald cheek out.the drainage first, on the following described property ;. <br />The westerly 120 feet of the easterly 328.71 feet of.the southerly. <br />208.71 feet of the Northeast Quarter of Section 26, T31,R22,Anoka <br />County, Minnesota. Subjec r to Birch St. <br />Seconded by Mr. Jaworski. Carried unanimously. Mr. Nadeau was advised to wait <br />until the Engineer had checked this out in order to protect all involved; then the <br />Clerk will write the variance for the building permit. <br />Imo. Cardinal moved to grant a variance to Ken Rehbein, on the Planning and Zoning <br />Board's recommendation, on the following described piece of land: <br />The East 13 feet of the West 163 feet of the South 252 feet of Lot 19, <br />Audi, Sub. No. 138, Anoka Co. Mn. Subject to CSAH. No. 14. <br />Seconded by Mr. Bohjanen. Carried unanimously. <br />Mr. Jaworski had no report. Mr. Rosengren stated that they have been working on <br />the East County Line and 50th. They had run into more expense about half way <br />through; he estimated the total to be about $10,000 when finished. He stated that <br />it would be another week before they are done; then they would begin cutting weeds. <br />Mr. Bohjanen asked if they would cut around the entrance signs, then stated that he <br />would do the hand cutting himself some night. <br />
