148 <br />12/27/71 <br />bidder; Mr. Locher advised that they could not do this without readvertising. <br />A change order os some sort if necessary could reduce the price to the low bid. <br />Mr. Gotwald read the separate items which were bid on. He stated that he had <br />talked with Layne - Minnesota and explained what his recommendation would be; <br />they stated that if the situation were reversed, they would like to do it that <br />way. He noted too that the legal ads and the specifications all stated that <br />the bid would be awarded in the best interest of the Village. <br />Following discussion, Mr. Rosengren moved to award the contract for the pump <br />and motor to Keys Well Drilling Co. in the amount of $3,000.00 on the recom- <br />mendation of the Engineer. Seconded by Mr. Jaworski. Carried unanimously. <br />Mr. Gotwald gave the reasons why the pump couldn't be advertised with the well. <br />Mr. L'Allier mentioned that Mr. Locher and Mr. Gotwald had been negotiating on <br />an easement relating to the Chomonix development which was necessitated due to <br />the County now requiring 100 feet for road easement on Birch St. The Delzer <br />property had only a 33 foot easement anda water main needs to be put in which <br />would be 5 feet outwide of the 50' line. The agreement signed by the Delzers <br />is as follows: <br />AGREEMENT <br />For and in consideration of the within agreement, and the execution of an ease- <br />ment by Edwin J. Delzer and Delores Delzer, for water main placement, the <br />Village of Lino Lakes agrees to pay said Delzers the sun of $209.00, based upon <br />$1.00 per front foot of the land owned by the Delzers. <br />The Village further agrees as follows: <br />1. To replace the plum tree in the Spring of 1972 with a plum tree, a young <br />tree, 6 -7 foot high. The existing plum tree shall not be replanted due to <br />its age. <br />2. To move the cherry treest there being 2 or 3, and if same do not grow, <br />same shall be replaced in the Spring of 1972 with cherry trees of similar size. <br />3. To install a 1" service to the Delzer's property line -- straight out from <br />the West corner of the Delzer's house- -and install a corporation box; all <br />at no charge to the Delzers, the Delzers not to be obligated to a hookup <br />fee or charge except for a plumbing permit fee should they decide to util- <br />ize the water and a monthly service rate and meter deposit. <br />4. To restore the surface, where disturbed to install the water main, to pre- <br />existing surface level with sod in the yard area and driveway surfacing <br />in the driveway area, comparable to existing driveway surface. <br />The foregoing is agreed to this 21st day of December, 1971 (signatures) <br />Mr. Locher stated that there were witnesses present when the agreement was <br />drafted who'stated that the Delzer's had a real nice yard and driveway com- <br />pacted of cement and motor oil. The corporation box would be installed with <br />the main. He noted that the Metro Council may put in the sewer interceptor <br />in which case, they would take the easement, not us. There was considerable <br />discussion on the cost of appraisal. <br />Mr. Rosengren moved to accept the above agreement and to authorize the Mayor <br />and Clerk to sign the agreement and to accept the deed. Seconded by Mr. <br />Cardinal. Mr. Bohjanen asked if a dollar value could be given for the trees. <br />It was felt that the total cost of tree replacement would not exceed $250. <br />Denny Houle questioned waiving the hookup fee, wondering if this was standard <br />procedure. Mr. Gotwald and Mr. Locher both felt that the amount for the water <br />hookup fee would be much less than the cost of appraisal. The vote on the <br />motion was unanimously in favor. <br />
