Glenn stated that he lives <br />here, and pays about the third highest taxes in the Village; he hires Village <br />people to work for him. He noted that we are indebted with the Jandric bonds. <br />Glenn suggested that the Village deed back the Shenandoah streets to him so he <br />can do all the work and then deed them back when the work is completed. He <br />stated that even if Pemtom or some other large builder were to cane in they <br />couldn't bond like this. He would provide a performance bond. <br />There was a very lengthy discussion with Glenn answering questions and stating <br />his feelings several times. Points brought out by the Council were that we <br />didn't want to get involved with any more sewer because this would increase the <br />flowage and the Metro bill; that there wasn't enough liability in case something <br />went wrong or Glenn went defunct; that the Village shouldn't have to haul the <br />sewage after they accept the system until the interceptor is hooked up. Mr. <br />Gotwald stated that most villages allow the contractor to do his own work and <br />only require a bond for road work; the contractor covers all engineering costs; <br />it only takes from 6 weeks to 2 months to do the sewer and water work and it is <br />not feasible to require bonding for such a short time; contractors automatically <br />carry bonds for liability. Glenn stated that he carries $1 million in liability <br />insurance. <br />Glenn was willing to put in writing that he would give over the sewer and water <br />systems for $1. The whole 40 acres will be developed before the streets are <br />put in and the Village takes them over. Tlenn offered to take care of the <br />pumping if he gets done before the interceptor comes in or turn it over to the <br />MSB to pump; this is the Sewer Board's decision. Mr. Gotwald noted that any <br />village pumping of sewage would be back- charged to the customers anyway. He <br />stressed that utilities are the responsibility of the Village, but this is <br />assessed to the customers. <br />Glenn noted fiat the streets can't be completed before people move in, but the <br />sewer and water will be complete; he will put up insurance and lien waivers. <br />Mr. Locher stated that the Village will not be responsible for the contractors <br />doing the work; we only supervise the engineering. Mr. Marier responded to <br />Glenn's comparisons with Jandric that he (Marier) didn't give Jandric the authority <br />or he wouldn't be there. <br />Mr. Bohjanen asked for the other's opinions. Mr. Jaworski felt that if the <br />Village is not liable in any way, he had no objection. Mr. Bohjanen asked if <br />the sewer and water would be in before they close the loan and was told Yes. <br />Mr. Cardinal stated that if Glenn accepts the liability there is no problem; he <br />noted that before we were asked why developers couldn't get sewer and water <br />before the streets were done and here Glenn wants to do this. Mr. Marier felt <br />there were a few legal things to take care of first. There was some discussion. <br />Mr. Gotwald commented that Glenn can't get a loan if this is not bona fide so <br />that he can reap a profit on the venture. Before anybody allows a contractor <br />to dig they need to get approvals. <br />Glenn stated that he plans to build 40 homes per year if he can only get going. <br />The second part of Shenandoah will have another 57 lots. There was discussion <br />on how to pay the Metro Sewer billing and on the portions designated for usage <br />and capacity. Glenn noted that he was trying to build homes to help pay this <br />off. Mr. Marier stated that without these tomes we won't have to worry about <br />it. Glenn stated again that he wanted to get the okays so he can get an idea <br />of how to go; if the Council won't allow him to go on his sewer and water, then <br />he will come in tomorrow for cesspool permits.
