1
1
1
267
5/22/72
There was discussion on whether a person had to attend both hearings on a variance
as a matter of procedure. Mr. Bohjanen felt it was unnecessary if there
had been no objections at the P& Z. Mr. Beens read from Ord. No.56, Sect.5.05
C., that petitioners shall appear before the P &Z; it doesn't say they shall appear
before the Council. Mr. Marier wondered whether persons requesting a variance
realized they would waive their total input if other questions came up. Mr.
Cardinal recalled that in the past we didn't require them to show up at the
Council hearing and that Mr. Locher had made this clear.
Mr. Bohjanen said that if there were no questions or objections on Ken Rehbein's
request we would act on it. Mrs. Swanson said she had questions to ask. The Clerk
was sent to Call Mr. Rehbein to appear.
While the Clerk was out of the room, Mr. Marier reported that a Bill Leonard had
requested extending 64th Street east to his property; this was held over to the
June Meeting. Fran Burque had been advised to submit a plat and survey for his plans
for 100' x 150' lots on the west side of 35E. Mr. Marier noted a correction in the
P &Z minutes on Fran Burque: "Centerville" should be changed to "Lino Lakes ". A Mrs.
Kohler had appeared before the P &Z asking for procedure to build a home on Mound
Trail; she had been advised to have percolation test. If that was satisfactory
she could get a building permit. Nor variance was needed since they had decided
to buy a 2 1/2 acre parcel.
Clark returned to the Council chambers after reaching Mrs. Rehbein who would
send her husband to the meeting.
Mr. Marier reported that the Robert Wilson property along Lake Drive had been
discussed again as he continued to haul in more fill. Mr. Myhre reported that.
Mr. Wilson has 10 Acres, that he has 2 trucks, a car and 3 horses in the pole
building which he put up. Mr. Cardinal moved that since Mr. Wilson has horses
in the building, he needs no permit to put it up, and that we drop the whole
matter and have the County check out the fill which Mr. Wilson is putting in
there. Seconded my Mr. Marier. Motion carried with Mrs. Swanson voting No.
Mr. Marier reported that Donald Lundgren had requested a variance on a piece of
land less than 2 1/2 acres and less than 150' of frontage. However, Mr. Lundgren
had agreed to add 30' to the frontage to makeit 150'. Mr. Lundgrenn came forward
to initial the change in the legal description to accommodate this. There was some
discussion.
Mr. Marier moved to grant to Donald Lundgren a variance to Ordiance No. 21A on
a parcel less than 2 1/2 acres in size described as follows:
Beginning at a point 538 feet from the. SW corner of SE 1/4 of SE 1/4 of Section
33, Township 31, Range 22, Anoka County, Minnesota; Thence East 150 Feet along
the South side of said Quarter; Thence North 200 feet; then West 150 feet; Thence
South to the point of beginning.
Also, that the Clerk - Treasurer be provided with a photocopy of the filing
papers after said parcel is properly filed at Anoka County. Seconded by Mr.
Cardinal. Carried unanimously.
Mr. Marier reported that Alvin Roetman had appeared at the P &Z for a variance
to divide land to provide for ^a roadway into the back part of his property.
The P &Z had denied his request since the property-was not on a dedicated road,
and there was less than 66' which would be put in for a roadway. Mr. Marier
moved to grant the P &Z's wished to turn down Mr. Roetman's proposal for a
roadway. Seconded by Mr. Cardinal. Carried.
