5/22/72 <br />Mr. Marier reported that the P &Z wished to change the wording of the sewer <br />regulations adopted on April 24th regarding percolation tests and submitting <br />site plans to them. The sentence will now read "Percolation test required to <br />be submitted to the Village Engineer'. The second sentence of that paragraph is <br />to be omitted in its entirety. Mr. Marier noted that it was a mistake on his <br />part that the second sentence had been included in the regulations. <br />Mr. Marier stated that the P &Z had held a discussion on who was to do these <br />perc tests. Mr. Gotwald had felt that it put the Village engineering firm in a <br />bad position to state that they must perform the perc tests. Also, they have a <br />two -week backlog on this sort of work, so that persons can't make the deadlines. <br />Mr. Marier felt that the regulations should read that the tests can be done by <br />the Village Engineer or any certified engineer. <br />Ken Rehbein had arrived and the discussion returned to his variance request. <br />Mrs. Swanson asked how are we going to control the drainage problems that may <br />come up with additional building on the site, and will the person buying this <br />have to comply or come before the P &Z. Ken Rehbein wondered what drainage problems <br />she was talking about, noting that there was no problem . on the parcel he wanted <br />the variance on. He stated that nothing can be done on the other parcel until it <br />comes before the P &Z and Council again. <br />Mrs. Swanson asked Mr. Rehbein if he intended to sell the larger parcel as he <br />had a sign up; Mr. Rehbein noted that the for sale sign didn't mean anything, <br />that in his business they sell if the price is right. He stated that there <br />should be more than 1 building on 3 acres, and they don't want to mortage the <br />whole piece for that onle building. He noted we should cross 1 bridge at a time, <br />there may be sewer in Lake Drive before something else is put up; he had nothing <br />in mind now for the other parcel. There was more discussion. <br />Mr. Marier moved that we concur with the Planning & Zoning Board's recommendation <br />to grant a variance to Ordianance No. 21A to Mr. Kenneth REhbein, for mortgage <br />purposes, to split a commercial piece of land at Main Street and Old Highway 8 <br />into two parcels having the following legal descriptions: <br />A. That part of the NW 1/4 of Section 9, Town 31, Range 22 <br />described as follows: Beginning at the intersection of <br />said NW 1/4 with the Northwesterly right of way line of <br />(Old U. S. Highway 8) ; then north along said West line, <br />, Anoka County, Minn,,. <br />the West line of <br />County Road 23, <br />a distance of <br />305 feet; then East at the right angle, a distance of 64.12 feet; then <br />southeasterly to a point on said Northwesterly right of way line of <br />County Road 23, said point being 300.00 feet from the point of beginning; <br />then southwesterly along said right of way line to the point of beginning. <br />B. That part of the NW 1/4 of Section 9, Town 31, Range 22, Anoka County, Minn. <br />lying northwesterly of County Road 23 (Old Highway 8) excepting therefrom <br />that part of the NW 1/4 of Section 9, Town 31, Range 22, Anoka County, Minn. <br />described as follows: Beginning at the intersection of the West line of <br />said NW 1/4 with the Northwesterly right of way line of County Road 23 <br />(Old U. S. Highway 8); then north along said West line, a distance of <br />305 feet; then East at a right angle, a distance of 64.12 feet; then <br />southeasterly to apoint on said Northwesterly right of way line of County <br />Road 23, said point being 300.00 feet from the point of beginning; then <br />southwesterly along said right of way line to the point of beginning. <br />with the stipulation that it be noted that here could be some drainage problems in <br />that area if a building should be constructed on Parcel B. Seconded by Mr. Cardinal <br />Carried unanimously. <br />
