82
6/12.72
Mr. Jack Dielentheis, U. S. Lakes Development Co., stated he thought action on
minimum room sizes was going to be tabled. They have townhouses being built
with 95 and 97 sq. ft. bedrooms and want to build more like them. Clyde Rehbein
also wondered why Mr. Marier was including this. He said P & Z had given it much
considerations and chose not to include it in their amendment, but to wait for the
new State code. He said the State code would be adopted July 1st and it will state
90 sq. ft. He said Senator Augdahl wants to know of any Village violations, because
they will not be tolerated. He said room size means nothing on the tax base. 90%
of his plans include a bedroom of less than 100 sq. ft. Did we waste our time, he
asked, going to the special P& Z meeting with builders?
Mr. Locher advised that the State says we can control the square footage of buildings.
The state might change them if: a) they are setup to keep low income housing out and
b) they preempted the field. He said there are going to be lots of court cases, in
his opinion. There are too many differences on draft for it to be accepted for the
whole State. He did note the State intends now to enforce the 90 sq. ft. minimum.
Mr. Gordy Howe, from the audience, said he had talked to Herb Meyer and that we
should check pages 86 and 87 of the Uniform blue book. It has been passed by the
Legistlature.
Mrs. Swanson, from the audience, said that the P &Z gave lots of thought to this.
If we get into 90 sq. ft. we get into low cost homes.
Clyde and Glenn Rehbein noted that this is Mr. Marier's personal motion added on.
not the P &Z's recommendation.
Mr. Bohjanen seconded the motion. Vote: Mr. Cardinal, No; Mr. Jaworski, No; Mr.
Marier, Yes; Mr. Zelinka, Yes; Mr. Bohjanen, Yes. Carried.
Mr. Bohjanen added that if when the State code becomes effective and it states
90 sq. ft. then we can amend our ordiance.
Mr. Locher reported that the insurance for the Civil Defense Auxiliary was in order,
received June 9th. Notice has been received from Northwestern National Bank that
$170,000 is paid and in order. He also has the application by Chomonix for an on
sale liquor license, and bond received. Robert Brand has signed it and is a Lino
Lakes resident. It comples with our ordinance. Their application was turned down
initially.
Mr. Jaworski moved to approve the Chomonix application for an on sale liquor license.
Seconded by Mr. Marier. Carried.
Mr. Locher said the Freeman liquor license application complies with our ordiance.
He said this ordinance was adopted in 1963 and a committee should probably be
appointed to look into it as it regards amounts of insurance coverage. Bond is
sufficient. The 10 day cancellation clause was included. Mr. Cardinal moved to
approve the Freeman application (off sale Liquor) and the Civil Defense application.
Seconded by Mr. Jaworski. Carried.
Mr. Locher said he hasn't heard anything yet about the burning ban. The Village does
have an ordinance about burning: Ordinance No 24 adopted in 1959, Page 89 of the
Ordinance book.
Mr. Bohjanen said he had received a letter from a concerned citizen about a high
school person working where liquor is being served. Mr. Locher read the Attorney
General's 1972 opinion on this, and said we are not in violation in this case.
1
1
1
