June 28, 1976 <br />and <br />109 <br />WHEREAS, the Metropolitan Council has indicated these plans and regulatory controls should <br />include zoning ordinances amendments, private sewage disposal regulations and interim <br />development controls applicable to "problem areas" which will ensure development densit- <br />ies and capacities to forestall the premature expansion and extension of the Lino Lakes <br />interceptor; and <br />WHEREAS, at the request of the City, the Metropolitan Council staff has provided further <br />definition of the expected plans and regulatory controls; and <br />WHEREAS, the City of Lino Lakes is willing to provide the Metropcbditan Council plans <br />and regulatory controls to coincide with the completion of the Lino Lakes interceptor; <br />NOW THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes: <br />I. The City will prepare and adopt plans and regulatory controls to protect metropol- <br />itan and City of Lino Lakes investments in the Lino Lakes Interceptor. <br />2. The City will accomplish plan and regulatory control adoption by December 31, 1976. <br />3. The City will prepare and adopt plans and regulatory controls which address Met- <br />ropolitan Council expectations in the following areas: <br />a. The City will define an urban service area based on the capacity of the Lino <br />Lakes Interceptor in the area served by the interceptor and will generally de- <br />find methods of allocating interceptor capacity during the next fifteen years <br />within this urban service area. The Lexington Park Lakeview area will also be <br />definded as an urban service area based on allocation of capacity in the Blaine <br />Interceptor. <br />b. Outside of the urban service area the City will establish development density <br />standards. These standards will apply on an interim basis while the City deve- <br />lops and adpots a long term rural area growth management strategy through the <br />municipal comprehensive planning process. <br />c The City will amend its zoning ordinance to include a restrictive saoil prov- <br />, inision. <br />d. The City will define existing and potential septic tank problem areas and adopt <br />approprtate offical controls to assure that development in such areas will not <br />create additional or new pollution problems. <br />e. If Minnesota Pollution Control Agency on -site sewage disposal installation and <br />maintenance standards are promulgated by November 1976, the City will adopt an <br />ordinance consistent with them. If MPCA regulations are not enacted by Novem- <br />ber 1976, the City will add on -site disposal system maintenance provisions to <br />the current City septic tank regulations which will be used until the MPCA re- <br />gulations become law. In either case the City will adopt on -site sewage disposal <br />provisions which will provide for the following: <br />1) Minimum standards for the installation of new systems. <br />2) Minimum standards and procedures for monitoring and maintaining new and <br />existing disposal systems. <br />3) Methods of improving existing systems which need upgrading to meet the est- <br />
