Seconded by Mr. Zelinka. Motion carried unanimously. <br />Mr. Karth moved to close the hearing at 9:25 P.M. Seconded by Mr. Schneider. Motion <br />carried unanimously. <br />Mr. Karth felt there should be some sort of a simple contract written between the <br />City and Mr. Schwankl in conjunction with the City's leasing of the road grader. <br />Mr. Locher will be here later - it was suggested he ask the Attorney. <br />Mr. McLean presented a request for a variance to split a parcel of land which had <br />been revieed by the Planing and Zoning Board and had been refused. This request <br />had been reconsidered at the last Planning and Zoning Board. Mr. McLean wondered a- <br />bout the time that must expire before a request can be resubmitted. Applications for <br />re- zoning must wait one year - he asked for research on the time for re- applications <br />on variances. <br />This application had been submitted by Mr. Emmitt Liebel to split his land into two <br />parcels and his son, Mr. Larry Liebel would build. This was re- submitted on a hard- <br />ship basis. <br />Mr. Zelinka asked if the consideration of making the existing home into a duplex had <br />been considered and Mr. Leibel said, Yes, this had been the first consideration. <br />Financing for the expansion of a 26 year old home is not available. The cost is more <br />than a down payment on a new home. <br />Mayor Bohjanen said he had been contacted and felt there should be no problem with <br />a split in that area and this should be allowed. <br />Mr. Zelinka said he had checked the area and could see no problems with the split. <br />The Planning and Zoning Board had recommended this spit be allowed on a hardship <br />basis and not intended to set a precedent. Mr. Zelinka moved to approve the Plann- <br />ing Zoning Board's recommendations. Seconded by Mr. Karth. Motion carried unanimously. <br />The hearing for the final plat for Colonial Woods was called to order at 9:30 P.M. <br />Mr. McLean read the letters from the Planner and Engineer. A letter from the Rice <br />Creek Watershed Board is in the mail. <br />There was a question on the extension of 62nd Avenue to the junction of the beginn- <br />ing of this plat. Mr. Edmundson felt this already has an easement, if not, then it <br />would become necessary that he acquire this land for a street. <br />It had also been recommended that cash in lieu of and be accepted for Park purposes <br />in this plat. Mr. Edmundson preferred to pay this in one lump sum placed on the <br />market value at this time. He said he would pay this money by the 1st of the year. <br />Mayor Bohjanen asked if there was anyone in the audience who had comments, either for <br />or against this plat. There was nons-. <br />Mr. McLean moved to approve this plat as presented with the stipulation that the nec- <br />essary land on 62nd either be acquired or by the use of existing easements be const- <br />ructed per City specifications, the interior streets be installed per City specificat- <br />ions, money in lieu of land for parks (this to be paid by Jan. 1, 1977), the acreage <br />
