Motion carried unanimous - <br />ly.. <br />Mr. Mike Kelly had asked permission to remove the excess soil accumulated in the pro- <br />cess of excavating for a duck pond on his property. A portion of the soil had been <br />used around a new home he is constructing. But the remaining soil is of no use to <br />him. This is an excess created by a project and the Planning and Zoning Board did not <br />feel this fell under the classification of mining and recommended allowing the excess <br />soil to be removed. Mr. Zelinka so moved. Seconded by Mr. McLean. Motion carried <br />unanimously. <br />Mr. Chancy LeVessuer had presented a request to split his land into two parcels. <br />This would leave two parcels of less than the required 22 acres, however, each par- <br />cel would have a front footage of over 190'. The Planning and Zoning Board h,--d re- <br />commended approval of this split providing the land is split into two equal parts <br />beginning in the center of lot line on the North and ending at the apex on the South. <br />Mr. Karth so moved. Seconded by Mr. McLean. Motion carried unanimously. <br />Three sign permits had been considered, #'s 29, 127 & 128. These signs have been <br />inspected and approved by the Building Inspector. The Planning and Zoning Board had <br />recommended approval. Mr. Karth so moved. Seconded by Mr. McLean. Motion carried <br />unanimously. <br />Mr. McLean said two other applications had been held and will be discussed at the <br />October meeting. Mr. McLean reminded the Council there will be a special Planning <br />and Zoning Board meeting on September 29, 1976 for work on the Metropolitan Requirement <br />in conjunction with the interceptor. <br />Mr. Roy Stanley and Mr. Roger Kolstad presented their preliminary plat for Sunset Oaks. <br />There are three areas suggested for neighborhood parks. Discussion of these areas and <br />the fact they are less than the required 10 %, introduced a suggestion that the devel- <br />oper complete these areas and turn them over tothe City as completed parks. There <br />was discussion as to when the Prks would be developed - as the area is developed? <br />Whebr it is completed? <br />Mr. Schneider suggested that when 4 of the land is developed, onepark be completed <br />to City specifications and turned over to the City. <br />Mr. Stanley agreed.- dependent upon the City's specifications. It was generally felt <br />this could be worked out between the developer, Park Board and City Council. <br />Mr. McLean reported the Planning and Zoning Board had given approval of the preliminary <br />plat. Mr. McLean moved to approve the preliminary plat subject to the recommendations <br />of the Planner, Engineer and Rice Creek Watershed Board reports; also a solution on <br />the Parks by the Park Board, as to location, size, and specifications for development. <br />To include deed restrictions on easements, and set the final hearing on the plat for <br />October 12, 1976 at 9:30 P.M. Seconded by Mr. Karth. Motion carried unanimously. <br />Mr. Schneider reported on the Park Board. He presented the Council with a list of <br />guidelines for the Park operations this coming hockey season. This is shifting the <br />basic responsibility to the Athletic Associations for flooding and maintaining the <br />rinks. <br />Mr. McLean asked about adult supervision - when would this be? Mr. Schneider said this <br />
