180 <br />November 22, 1976 <br />Mr. McLean presented the recommendations of Mr. Gotwald dated October 6, 1976. Mr.Schn- <br />eider read the recommendations from the Park Board. He asked who is responsible for <br />determining the value of the land to be donated for Park purposes? Mr. McLean said <br />this is done by the Council in conjunction with the developer. <br />This plat proposed less than 10% of the total acreage for Park purposes with the money <br />to be used for the development of the proposed park areas. This is a combination of <br />land and money proposal. <br />Mr. Kolstad had a letter from the Rice Creek Watershed Board dated Nov. 4, 1976. This <br />was read. Mr. McLean suggested dealing with the Park problem as an open end type of th- <br />ing. <br />Mr. Locher reminded Mr. Stanley this plat must go the the County Surveyor for final <br />work before presenting a hard shell for signatures. <br />Mr. McLean asked Mr. Locher if there were any other points that should be covered. <br />Mr. Locher said on the Parks, the money could be put in escrow. Mr. Karth suggested <br />concurring with the method suggested by the Park Board. <br />Mr. McLean moved to approved the Sunset Oaks Plat as presented with the following st- <br />ipulations; drawing and legal description checked by the Attorney, conform to the lot <br />restrictions as outlined by the Rice Creek Watershed Board in their letter dated Nov. <br />r, 1976, conform to the recommendations of the City Engineer in his letter dated Oct. <br />6, 1976 in reference to street grades, plans and drainage, conform to the recommend- <br />ations of the City Planner in his letter dated Sept. 23, 1976, subject to approval <br />of the An oka County Surveyor. Mr. Schneider added there be three parks according to <br />Ordinance 21B, with the escrow to be established within 60 days, this escrow to equal <br />10% of market value as assessed, two parks to be completed as tot lots and the northern <br />most park to include a baseball field. Mr. McLean accepted the addition. Mr. Schneider <br />seconded the motion. Motion carried unanimously. <br />Mr. Karth moved to have Mr. Kelling compute the market value on the land. Seconded <br />by Mr. Schneider. Motion carried unanimously. <br />Mr. Karth moved to close the hearing at 9:25 P.M. Seconded by Mr. McLean. Motion <br />carried unanimously. <br />The Clerk's report was continued. <br />A petition from the residents of the 8200 block of Lake Drive and the residents of Pine <br />Vista asking the City Council to prohibit the construction of a snowmobile and mini - <br />bike repair shop by Darwin Heyd at 8235 Lake Drive. <br />Mr. Locher said that Ordinance 6 requires a 300' frontage for a commercial use in a <br />residential area unless there is a special use permit. <br />Mr. McLean moved this petition be entered in the minutes and the petition be kept on <br />file in the event of a building permit application. The matter could be dealt with <br />at that time. Seconded by Mr. Karth. Motion carried unanimously. <br />The Rice Creek Watershed Board had sent notice of the approval of two permit applicat- <br />ions for the installation of irrigation wells to be installed on the East side of the <br />City. <br />Mayor Bohjanen said he was concerned on the number of this type of wells that is being. <br />
